Is this Trump’s “secret plan” to end DACA?

If you listen to NBC News (and several other outlets), the President has hatched a diabolical new top-secret plan to eliminate DACA and boot all of those lovable “Dreamers” out of the country once and for all. This comes as something of a surprise since the only things keeping DACA afloat at the moment are a couple of court injunctions, and upcoming congressional action may make the entire question moot anyway. But be that as it may, let’s examine this scheme. Take it away, NBC.

In a motion filed late Friday, Justice Department lawyers asked a judge in Texas to rule that the program violates federal immigration law. Assuming, as expected, that the judge grants the request and orders the government to stop enforcing DACA, the ruling would conflict with orders from two other federal courts that require continued enforcement of the program.

If faced with competing court orders, the Justice Department said it would then rush to the U.S. Supreme Court and tell the justices that the government would be in violation no matter what it did — keeping DACA going would violate the Texas order, while trying to shut it down would violate the other court orders.

In that event, the government would ask the Supreme Court to put a hold on all the lower court rulings. And if the justices agreed, the Trump administration would be free to shut DACA down immediately, because nothing would be in effect to prevent the government from taking that action.

The funny part of this story is that the end result could, at least in theory, be precisely what the report predicts. Judges in California and New York have ruled that the government needs to continue accepting DACA renewal requests. If a judge in Texas rules that the program itself is illegal, then the White House is left between a rock and a hard place. Whether they end the program or continue accepting renewals they will be in violation of a court order. That could certainly compel the Supreme Court to act quickly and either put the entire thing on hold or rule on the legality of the program and whether or not the President has the authority to end it. (Spoiler alert: that’s probably not going to end well for DACA advocates.)

But what’s the actual motivation for the Department of Justice in doing this? The White House (along with most conservatives) has been arguing that DACA was either illegal to begin with or it fell under the discretion of the executive branch to modify or end it at the president’s discretion. Taking a fresh run at that question with a court in Texas is a logical step in attempting to prove that point. And if Congress can get off their butts and actually pass an immigration bill for the President to sign, the executive order ceases to have any real meaning anyway. That’s what Trump has been pushing for since he made the initial announcement.

Personally, I’ve never seen much merit in the argument that Obama wasn’t able to institute DACA unless we want to dig deeper and place some sort of limit on executive power as wielded through such orders. (And who wants to do that, amirite?) The more compelling case to make here is to simply say that if a president can create such a program in an extra-legislative fashion with the stroke of a pen, a subsequent president can modify or terminate it the same way. And you can call me a sentimental fool if you wish, but I predict that the Supreme Court would see it the same way.

Thefts Rise After California Reduces Criminal Penalties

California voters’ decision to reduce penalties for drug and property crimes in 2014 contributed to a jump in car burglaries, shoplifting and other theft, researchers reported.

Larcenies increased about 9 percent by 2016, or about 135 more thefts per 100,000 residents than if tougher penalties had remained, according to results of a study by the nonpartisan Public Policy Institute of California released Tuesday.

Thefts from motor vehicles accounted for about three-quarters of the increase. San Francisco alone recorded more than 30,000 auto burglaries last year, which authorities largely blamed on gangs. Shoplifting may be leveling off, researchers found, but there is no sign of a decline in thefts from vehicles.

Proposition 47 lowered criminal sentences for drug possession, theft, shoplifting, identity theft, receiving stolen property, writing bad checks and check forgery from felonies that can bring prison terms to misdemeanors that often bring minimal jail sentences.

While researchers can link the measure to more theft, they found it did not lead to the state’s increase in violent crime.

Violent crime spiked by about 13 percent after Proposition 47 passed, but researchers said the trend started earlier and was mainly because of unrelated changes in crime reporting by the FBI and the Los Angeles Police Department.

The administration of San Juan Mayor Carmen Yulín Cruz, who was sharply critical of President Donald Trump after Hurricane Maria devastated Puerto Rico last year, is reportedly being investigated for alleged corruption.

In a report from El Vocero de Puerto Rico, the FBI is investigating several suppliers in a probe launched after former procurement director Yadira Molina filed a lawsuit claiming she faced punishment for reporting illegal activities to the local comptroller.

The investigation has since grown to include several contractors, the news outlet reported, according to Epoch Times.

Carlos Osorio, a spokesman for the FBI in San Juan, told Epoch Times last October the agency received several complaints of alleged corruption in the distribution of relief goods, and that it was required to look into the matter.

Prof who went on racist tirade at white kids goes to meet harasser, says reverse racism isn’t real

Rutgers professor James Livingston is tripling-down on his remarks that his anti-white child rant wasn’t at all racist — and he even went as far as to meet someone from the internet who had reportedly been sending him death threats.

What’s a brief history?

Livingston went on a racist Facebook rant against white kids and their parents after visiting the  restaurant, Harlem Shake, on May 31 in Harlem. The rant has since been deleted from his page.

Livingston would later reveal that he received death threats as a result of his posting.

Days after his initial remarks, Rutgers University announced that it would be launching an investigation of the professor and his remarks.

A statement from the Rutgers University Media Relations department said, “There is no place for racial intolerance at Rutgers. This matter has been referred to the appropriate leaders at the Rutgers-New Brunswick campus, where Dr. Livingston teaches, to determine whether his comments violate university policies prohibiting discrimination and harassment.”

The owners of Harlem Shake condemned Livingston’s remarks in a scathing statement provided to TheBlaze, noting that he is no longer welcome in their restaurant.

Jelena Pasic and Dardra Coaxum told TheBlaze, “For five years and counting, we built our business on a prerogative [of] cherishing diversity within our ownership, staff and customers in our beloved Harlem COMMUNITY. We refuse to be sucked into your racist rants, so if you wish to name drop, please use names of those with similar views.”

“We ask that our name is removed from your rant because we do not want to have anything to do with you,” the women added. “And yeah, we ask that you get your burgers somewhere else. We do not tolerate ‘racism’ either. We thrive on equality and fairness and have full intentions to keep it that way!”

He initially tried to explain his comments in a blog post by saying that they were just a joke, and said that he believes “reverse racism” doesn’t exist.

Livingston concluded the post by writing, “I don’t want to be black. I just don’t want to be white.”

What did he say in a recent Facebook post?

In a Facebook post Wednesday, Livingston explained that he returned to the same restaurant — whose owners asked him not to come back — to meet with an online critic who’d reportedly served him with death threats.

“I spent an hour at Harlem Shake today, waiting to meet with one of the morons who have threatened me with bodily harm,” Livingston wrote. “‘Beefy tips,’ he called himself, and promised to f*** me up.”

“It was his idea to meet in person, I just took him up on it,” the professor explained. “But look, I knew he’d never show — these people are cowards as well as morons.”

“Besides,” he added, “I brought back-up in the form of a former student, armed with a camera. ‘Beefy’ never arrived, of course, but a TV camera crew was there all the while to record my thoughts on reverse racism, of which I stand accused.”

“No such thing as far as I’m concerned,” Livingston concluded. “Racism is about power, not hatred, although the two can go together.”

What is he saying now?

Livingston spoke to WPIX-TV, where he further expounded on his remarks.

“Why am I doing this? This is the question,” Livingston told WPIX.

Calling his Facebook post “ironic” and “facetious,” Livingston explained that he was trying to “be funny,” but added that “there’s a serious intent behind every satirical statement.”

“It was my way of … making fun of gentrification,” Livingston said, “but it’s not very funny.”

Of “Beefy Tips,” Livingston said, “F*** him. That’s why I showed up here for that a**hole who threatened me via email. He threatened my life, that f***head.”

“There’s no such thing as reverse racism,” he told WPIX. “Racism is about power. It’s not about hate. If you have power over [someone] and you’re a white person, that’s racism.”

“White people have exercised power over black people for, what, four centuries?” the professor added.

“So when I say I hate white people,” Livingston concluded, “all I’m saying is, ‘Enough already.’”

Credit card company stops payments on gun-related sales — but there’s more to the story

The New York Post reported that Intuit stopped processing credit card payments — and even reversed some charges — on gun-related sales. However, Intuit fired back, saying that the report did not reveal the full story and that the policy that stopped the processing of certain gun-related sales has been in place a long time.

What did the Post report?

On Monday, the Post published an article with a headline that read “Intuit stops processing payments on all gun purchases.”

Lois Weiss, the article’s author, wrote:

Several gun-related businesses were suddenly — and without warning — disrupted in recent weeks when Intuit stopped processing credit card payments because phone and internet sales were gun-related, The Post has learned.

Some of the payments stopped didn’t even involve firearms, but simply T-shirts and coffee mugs and gun safety classes, according to small business owners.

One person impacted was Ken Campbell, a former Indiana sheriff and current owner of Gunsite Academy in Paulden, Arizona.

Campbell told the Post that he spoke to Intuit, who told Campbell that “it mistakenly believed firearm sales were being made directly to the customers, which it requires for such items.”

Campbell, however, said that the firearms were shipped to a local dealer who possessed a federal firearms license and complied with mandatory background checks.

He said that Intuit didn’t care and said that if he was aware of the company’s policy that gun sales must be made face to face, he would not have used them.

“It’s fine, it’s capitalism, and if you don’t want to do business with us, we don’t want to do business with you,” he told the Post.

The Post reported that Intuit issued a statement on the matter which said:

As an American company, we respect the US Constitution and all the rights contained in it … For these transactions our bank partner requires them to be done face-to-face … Our policy today requires the customer to be present to swipe their credit card.

So what’s the policy?

Heather Mclellan, a spokesperson for Intuit, told Guns.com Tuesday that the company’s policy on firearms is “not new, nor has it changed.”

Mclellan said, “Our company does NOT prohibit ANY of these regulated industries — including the firearms industry — from using QuickBooks for payment processing.”

“In fact,” she added, “many do so today.”

“However, for these transactions our bank partner requires them to be done face-to-face,” Mclellan continued. “To meet this requirement, our policy today requires the customer to be present to swipe their credit card.”

Mclellan explained that when transactions are “keyed in” by a vendor — “including online and over the phone” — Intuit is unable to verify whether or not the customer was present for the transaction.

She added that that very issue conflicts with the company’s “long-standing financial safety policies in the electronics payment industry.”

“All of our customers agree to these terms when they sign on to use our services,” Mclellan told the outlet. “When a customer of ours is unable or unwilling to meet this commitment, we reach out to them directly to explore a solution to the problem or to transition them off of our service.”

Ongoing Unemployment Drops to Lowest Level Since December 1973

Jobless claims unexpectedly fell last week, according to data from the Labor Department Thursday.

New filings for unemployment benefits fell by 4,000 to 218,000. Economists had expected a rise to 225,000.

The four-week moving average of claims, considered a better indicator of job market strength because it evens out week-to-week volatility, also fell.

Continuing claims for state unemployment benefits dropped to 1.7 million, the lowest since December 1973.

Throughout the 2016 presidential campaign and particularly since Donald Trump’s electoral victory and subsequent inauguration, Never Trumpers across the political spectrum have been hysterically decrying the existential threat the president poses to, variously, our economy, “our American values,” the “international order” (to the extent that one may be true, it’s about time someone did!), our security alliances and democracy itself. Bill Maher, caring and wise leftist that he is, longs for a recession, as that offers the best chance of getting rid of Trump; who needs all those stinking jobs anyway? A befuddled George Soros recently observed that “everything that could go wrong” has indeed come to pass and moreover, he is certain that Donald Trump is “willing to destroy the world.” Oh, and lest you haven’t heard, Trump is a racist, sexist, xenophobe, homophobe, Hitler, fascist (a word that has lost all meaning in modern popular discourse) and the dumbest man ever to be elected president.


Yet in all of these dire warnings and assertions, precious little evidence for such eschatological claims is ever offered, even as all data to the contrary is studiously ignored. Indeed, the only proof that his critics conclusively, if inadvertently, demonstrate is that they really, really, really dislike the guy.



So the next time a liberal friend makes some variation of apocalyptic declaration about the man who has created a global high-end real estate empire; won the presidency against all odds, with 93% of the mainstream media acting as cheerleaders for his opponent; passed major tax reform and directed targeted regulatory reform that has ignited the economy and wage growth after eight stagnant years of sub-par performance. And now, he is on the verge of re-making the global order so that it works better for America, as well as the rest of the world. You might want to ask that friend, “What precisely is your basis for such a claim?” One hundred bucks says that all you will get back is some version of “because…Trump!” As annoying as that fact-free perspective may be, those of us who live in the real world may take heart: America is becoming great again, right before our eyes.

‘We’re teaching children lies’: Hollywood actress takes on public education, evolution, and marriage

Actress Sam Sorbo is on a mission to help improve education, telling PureFlix.com’s “Pure Talk” that she is deeply concerned about the state of schooling in America.

Sorbo, who is a passionate homeschool mom and the wife of “Hercules” actor Kevin Sorbo, made it clear that she believes education is one of the most essential issues of the day.

“Education colors your worldview … and it colors the way you approach every problem,” she said. “Education is literally foundational.”

Sorbo warned that she believes schools are teaching kids that “life doesn’t matter,” that it is “just a series of accidents” and that evolution is true.

“We’re teaching children lies and then we wonder [why] they act out,” she said.

Sorbo added that she’s a strong advocate for home education, as she has homeschooled her own kids and believes in the power of parents controlling what their children learn.

The actress and author also went on to discuss the importance of marriage, explaining how she and her husband have built a strong and long-lasting union despite working in such a challenging industry.

“We set our priorities when we got married,” Sorbo said, adding that she and Kevin committed early on to never spending more than two weeks apart.

Twenty years later, the couple is still going strong, surviving in an industry that too often creates and fosters relationship-ending pitfalls. The two recently co-wrote a devotional titled, “Share the Light: 40 World-Changing Devotions.”

“In Hollywood, careers tend to diverge,” Sorbo said, explaining that the different demands that performers face as their careers sometimes lead them to move apart from their spouse.

She recalled how, at the start of their relationship, she found herself questioning how she would pursue her entertainment career in Los Angeles while Kevin filmed his former TV show “Hercules” in New Zealand.

“I was just going, ‘I wonder what this is going to look like’ and then [Kevin] had three strokes,” she said, explaining that this posed newfound challenges. “I had to make a choice … I [needed] to give up my career in order to be there for this person that I love.”

Kevin’s health struggles eventually led Sorbo to make a major sacrifice — to put aside her career for the good of her family and marriage.

During that time she learned quite a bit, admitting that she’s not sure the marriage would have endured had both she and Kevin continued their respective careers and potentially grew apart.

“As Christians, we find in our sacrifices great gifts,” she said. “In fact, it was a gift. It was a gift to me because I don’t know that our marriage would have survived.”

Sorbo continued, “Instead, we grew together, we came together.”
