Another disappointing U.S. Supreme Court term came to an end a few weeks ago. From a conservative perspective, it is exceedingly difficult to find much with which to be enthralled.
The most important thing Robert Mueller revealed today in his testimony before the House Judiciary and Intelligence Committees was that he didn’t really know that much about the work of the investigation that bears his name — and that he is prone to senior moments with alarming frequency. That he could in no way have been the actual leader of a large team of high-powered lawyers is now obvious to everyone in cringe-worthy detail (a veteran prosecutor unable to come up with the word “conspiracy” as the legal term for collusion). He was a BINO, a Boss In Name Only, or, colloquially, a front-man.
Under the Mueller brand, dodgy prosecutor Andrew Weissmann could work with his Trump-hating cabal of Hillary supporters, Mueller’s right-hand man Aaron Zebly there to keep an eye on things for him. Wrapped in a Mueller’s cloak of prestige and legitimacy, the cabal could take down a president, they thought.
But now that the public can see with their own eyes that Mueller was at best “Mr. Outside,” and the story arc turns toward investigating the investigators. Now we know that we were misled. That creates more interest in getting to the turth of who was really running this project. Before boarding Marine One today on his way to a rally in West Virginia, President Trump said that investigating the investigators is what is next, as see the fruits of the Horowitz IG report, and prosecutors Huber and Durham work in secrecy with grand juries. With 14 months until the election, the most successful reality TV producer in the history of the medium knows that narratives can flip, with the good guys exposed as less worthy than was first apparent, and the underdog comes to the fore, and it makes compelling viewing.
This revelation is huge problem for the media that has portrayed Mueller as a legend in his own time, a man of unquestionable integrity, brilliance, and devotion. Their puffery has exploded in their faces like an Acme cigar in a Warner Brothers cartoon. The entire narrative that the media and other Democrats have peddled since shortly after Hillary Clinton lost in 2016 is busted on multiple levels. The last gasp for Nadler, Schiff and the unofficial House impeachment caucus was the hope that Mueller would use that persona that doesn’t seem to exist anymore, if it ever did, to sell the public on the notion that Donald Trump is a criminal. Unfortunately, he was clearly not up to the job.
All but the fanatics – a not insignificant portion of the – House Democratic Caucus –realize that the game is over.

Pens and phones, once established as precedent, tend to persist. The Trump administration got a perhaps surprising win in federal court earlier today on its decision to impose a de facto “safe third country” policy on asylum regardless of whether an agreement exists for that purpose. Judge Timothy Kelly declined to issue an injunction against the policy change, which will deny asylum in almost all cases where an applicant comes through another country to claim asylum in the US:
In a ruling issued from the bench, Kelly said the plaintiffs had not proved they would suffer “irreparable harm” as a result of the asylum ban. While Kelly acknowledged the policy could have “far-reaching and significant effects,“ he found that plaintiffs failed to demonstrate sufficient harms to halt the regulation.
The decision provides a short-term win for President Donald Trump, who has sought to diminish the flow of Central American migrants arriving at the border by toughening the asylum process. The administration issued a fast-track regulation last week that bars asylum for migrants who pass through other nations and do not seek refuge in those places.
Until now, this “safe third country” practice had been limited to countries with which we have reciprocal diplomatic agreements to that effect. We have that with Canada, for instance, but not with Mexico, although Trump demanded if Mexico couldn’t stop the deluge of migrants transiting their country. Using tariffs as leverage, Trump backed Mexico into a corner and forced them to start taking border security seriously.
Without the diplomatic commitment, though, one might have expected the court to have a knee-jerk reaction to a sudden and significant change in asylum practice, at least without some authorization from Congress. It wouldn’t be necessary to strike down the policy change, but a temporary injunction could easily have been expected, especially with the track record of such challenges to Trump’s other immigration-policy efforts, like the so-called “travel ban” attempts in 2017. Kelly appears to have avoided such a move by focusing on standing more than the policy:
The groups had asked the court to find that Congress did not intend that mere transit through another country would render an applicant ineligible for asylum in the United States, and to rule that the policy did not comply with required procedural steps. Judge Kelly, however, disputed the plaintiffs’ contention that Attorney General William P. Barr overstepped legal requirements when issuing the rule.
“I think at this point, the plaintiffs are reading too strictly a limitation on the Attorney General’s authority,” Judge Kelly said.
He also found that the two advocacy organizations did not provide sufficient support for the contention that there would be “irreparable harm” to the plaintiffs in the case if an immediate, temporary block to the policy were not imposed. While the rule would impact migrants seeking asylum, “The plaintiffs before me here are not asylum seekers,” the judge said.
“They are only two organizations, one of which operates in the D.C. area, far from the southern border,” he said.
It’s worth noting that Kelly is a Trump appointee, but not a Trump rubber stamp. It was Judge Kelly that ordered the Trump administration to restore Jim Acosta’s access to the White House, not exactly a popular decision there. However, while Kelly stayed away from the merits of the underlying challenge at this stage, he did note that when that time comes, the “severely strained” immigration system would be one key aspect of his deliberations. That has to be welcome news in the West Wing.
Don’t expect Kelly to get the last word on an injunction. Other plaintiffs will likely look for friendlier turf — Hawaii, anyone? — to get a more favorable temporary outcome. By this time, we all know the playbook.
Hate crime hoaxes have become a tried and true American tradition. We can generally count on a spate of high profile hoaxes to mark each season, especially since President Trump was elected.
Chad Robichaux, the founder of the Mighty Oaks Foundation, a faith-based organization that helps veterans, has shown evidence that Google blacklisted the term “Christian” from its Google Ads advertising platform, but the keyword “Muslim” is allowed to be included with no issues. Robichaux told Breitbart News that banning faith-based keywords in advertising is “absolutely crippling” to the organization’s growth.
Recently, Chad Robichaux, a Force Reconnaissance Marine and founder of the Mighty Oaks Foundation, which helps military veterans dealing with PTSD, explained on social media that ads posted through Google Ads with the keyword “Christian” included were not allowed. Robichaux tested whether this applied to all religious language and references but found that the term “Muslim” was accepted by Google Ads with no issues. Robichaux’s initial tweet showing the “Christian” term being refused can be seen below:

Robichaux then attempted to use the term “Muslim” which was accepted by Google Ads:

Robichaux appeared on Breitbart News Tonight on Tuesday to discuss the incident and the other forms of censorship that his organization has faced. He stated: “One of our YouTube videos might get like 2,000 views, and then we have someone like Allen West come on who’s got quite a bit of notoriety and we get, like, 60 views… I would assume there’s some suppression there, I can’t prove that but what I can prove is this ad, in particular, we’re talking about.”
Further discussing the banned “Christian” keyword, Robichaux stated: “Honestly, I hope I’m not on the radio station next week badgering them, I hope they do the right thing and change this policy.” Listen to the full interview below:

As a faith-based non-profit organization who serves our nation’s military warriors and families, Mighty Oaks Foundation’s outreach is crucial to our mission. We use and rely on the continued functioning of the major social media platforms daily to deliver our message, including the ability to use Google and YouTube’s tools for ads and sharing media and testimony. We produce a program weekly called Mighty Oaks Show, which is based on YouTube and shared and promoted with ads to their platform. Yesterday, our Marketing Team, went to create an ad to promote this week’s guest Darrin Dick, the Director & Producer of the new documentary Unforgotten, a story about his veteran grandfather, faith and his memories of the almost forgotten Korean War. When trying to use the keyword, Christian, to help target the ad at our audience, they received this response, “The following keywords violate Google Ads advertising policies. Please remove the unacceptable content to continue. Unacceptable Content as Keyword: “Christian.’” This is the first time we have encountered anything so extreme, it blocked us from proceeding to place the ad without deleting the keyword.
Having the advantage of a front-row seat for the media output of our organization, I have witnessed many issues that may not sound distressing on their own, but in concert with many other faith-based, conservative and patriotic organizations, and in-sight of the negative impact they have had on our growth, these consistent issues become very concerning. First and foremost, posts about issues that our veterans are facing had been declined many times for Facebook “boosts,” and classified as political issues of national importance, when our posts have no political alignment to the left or right, our only alignment is with our nation’s veterans and the military community. This roadblock becomes critical when you look at the social media landscape, and the reach of our message has been consistently diminished through both search and post algorithms, making ads a necessary evil for us to reach those who may desperately need our message and assistance.
Robichaux further discussed the work that the Mighty Oak Foundation does and how limiting their advertisements can prevent individuals seeking help from finding them:
Ultimately, as a faith-based organization prohibiting us to use the word “Christian” is absolutely crippling to our growth and our ability to reach those who need our help and message. The Mighty Oaks Foundation relies on social platforms to reach the military communities struggling with PTSD, extreme rates of divorce and the 20+ per day suicide epidemic. Since 2011, Mighty Oaks has served over 100,000 active duty military through Spiritual Resiliency Programs and has over 2,750 graduates from our intensive combat trauma program. We host over 30 one-week programs per year for active military, veterans and spouses all for free to include travel to our four ranches in TX, OH, VA and CA. These restrictions and bias may not seem like much to an outsider, or those who don’t rely on digital media to reach audiences, but for us, we are being restricted from sharing a lifesaving outreach to those who desperately need our help.

Sen. Bernie Sanders’ (I-VT) presidential campaign is facing a federal complaint made by an unnamed individual alleging violations of the National Labor Relations Act, including allegations of retaliation, repudiation, interrogation, discipline, and discharge, it was revealed Tuesday.
An unnamed individual filed the complaint to the National Labor Relations Board July 19, alleging five potential violations.

However, as Bloomberg Law notes, “any person” can file a complaint. It does not necessarily mean a staffer filed the complaint.
“The NLRB has yet to make a determination about whether there is any merit to the allegations,” Bloomberg Law reports.
The accusations follow complaints from Sanders campaign employees, who claimed the campaign was paying “poverty wages.” Union members drafted a letter to Sanders’ campaign manager Faiz Shakir, which stated that field organizers “cannot be expected to build the largest grassroots organizing program in American history while making poverty wages.”
“Given our campaign’s commitment to fighting for a living wage of at least $15.00 an hour, we believe it is only fair that the campaign would carry through this commitment to its own field team,” the letter added.
Sanders told the Des Moines Register that he was bothered that the complaints were made public.
“It does bother me that people are going outside of the process and going to the media,” Sanders said. “That is really not acceptable. It is really not what labor negotiations are about, and it’s improper.”
While he initially said he would address the issue by limiting employee hours, Sanders announced that the campaign reached a deal with unsettled staffers.
“We made an offer which would have addressed that problem several months ago; it was rejected,” Sanders told CNN. “We underwent negotiations. It has now, the offer, it has been accepted.”
“We have and will always be committed to the fight for fair pay, decent work conditions, and a strong labor movement — for our own workers and those all across this country,” Shakir said, following the agreement.
“We’re proud to have successfully negotiated with the union in good faith to raise the pay of field organizers while continuing to ensure our campaign staffers are being paid a living wage,” he added.
Even Michael Moore agreed that Mueller was not on his game.
