Horowitz: Time’s up: Trump doesn’t need permission of cities participating in insurrection to send in military

How is it that we are two weeks into an armed insurrection in Seattle, where local politicians let terrorists take over a police precinct and several city blocks and prevent all city services from entering? How is it that Americans continue to get beaten out of their cars by lynch mobs, and it appears there are no police in sight? Every Republican tells us that re-election of Trump is the most important outcome we can strive for, but he is president right now. He holds the power of the federal government. Are we really at the mercy of local governments ignoring or downright participating in the insurrection?

This question was settled long ago. State governments never had the power to violate life, liberty, or property, pursuant to Art. IV, §2, cl. 1 of the Constitution, which prohibited states from violating core natural rights from the very first day of the republic. In 1867, however, the 14th Amendment’s Privileges and Immunities Clause gave the federal government enforcement power over states that violate those natural rights, which were specified at the federal level in the Bill of Rights after states had already adopted the original Constitution.

In response to the Civil War, Congress passed a law in 1871 to authorize the president to put down any insurrection. It was the original enforcement legislation designed to put teeth into the 14th Amendment, as envisioned under Sec. 5 of that amendment, which authorizes Congress to enforce violations by states. It’s law to this day under 10 U.S. Code §253 and was amended in 2008 to apply to natural disasters and terrorism.

The President, by using the militia or the armed forces, or both, or by any other means, shall take such measures as he considers necessary to suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy, if it—

(1) so hinders the execution of the laws of that State, and of the United States within the State, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or

(2) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.

There are no limitations on the time, methods, or place in which the president can deploy the military to put down insurrection and domestic violence. With the anarchists desiring to relive the Civil War, it’s time to use a Civil War-era law to put down this rebellion, as the law was designed to do.

What we are facing today in many cities is the worst unlawful combination of insurrection and violence that is hindering numerous state and federal laws, blocking highways and threatening motorists, and destroying businesses and property. Everyone seems to think that the president needs the permission of the state to deal with this, but the law was clearly designed for when “authorities of that State are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection.”

The language of “privileges and immunities” was taken from the then-recently passed 14th Amendment to ensure that states couldn’t get away with ignoring people’s inalienable rights. Trump and Senate Republicans need to up the ante and threaten to invoke this statute if states and cities continue to allow “autonomous zones” and rioters to maim, loot, burn, steal, and obstruct traffic.

Obviously, we were all reluctant to immediately deploy the military and were hoping that local police would finally come to their senses, as they always have in the past after a few days of rioting. However, three weeks into this insurrection, many of these city governments have downright joined in the insurrection, which has led to direct threats to the lives and property of all Americans indefinitely. Truckers now have to rethink where they deliver goods, as if this were Afghanistan, where you need a map to see where the government has full or partial control over the territory.

With California officials downright encouraging this behavior and preventing the police from stopping it, the president is obligated to step in. The philosophy behind the 14th Amendment and the 1871 law to implement it is that the federal government was created for situations where states are either inherently incapable of defending liberty (a foreign invasion) or when they refuse to protect liberty and downright promulgate tyrannical edicts against life and property. Slavery and Jim Crow had to be swatted down by the federal government. Now these riots and beatings need the same response.

The police have been made to be criminals while the criminals are being exalted as civil rights leaders. This cannot go on longer. We cannot wait until November. Trump is already president and already has all the authority he needs. It’s time to use it.

It’s tough trying to keep track of the crazy emanating from Democrats

I regularly read the internet looking for stories and opinions to be the starting point for articles. On Thursday, I searched for just one or two stories for posts. Instead, I found myself saying, “The Democrats have gone crazy. There is no one story. Thanks to Black Lives Matter, they’ve gone around the bend, and they’re trying to take America with them.”

I realized that those endless crazy moments are the “one” story because they show how the Democrat party is breaking with American norms and embracing cultural mass hysteria. This post collects just some of those moments.

Remember those “nooses” in the park in Oakland, California? The mayor of Oakland (the same woman who warned criminal illegal aliens that ICE was coming for them) stated that these nooses were hate crimes:

In fact, the “nooses” were exercise ropes with hand grips. A black man put them up so that he and his friends could do strength training in the park.

The town of Carmel, California, filed criminal charges against a restaurant for allowing sit-down, in-house dining in May. The restaurant was able to negotiate a $35,000 fine instead. The owner, Jeffrey LeTowt, contends that he did nothing wrong, adding that “More people die from the flu every year. Definitely not something you shut down the world’s 5th largest economy for.”

At a restaurant in Swampscott, Massachusetts, a bartender eavesdropped intermittently on a table at which a member of the town’s Select Board sat. The bartender allegedly heard the Board member say there is no such thing as “white privilege,” and the Black Lives Matter movement is “liberal bulls**t.” The bartender was so “distraught,” he naturally posted about it. The restaurant first fired the bartender, but then backed down in the face of mob outrage. It offered to hire him again and banned the Board member from the restaurant. The Board member denies the statements.

The movie Forrest Gump is in the woke mob’s crosshairs because it’s hostile to protesters and the counterculture. Worse, the lovable Gump, who doesn’t have a racist bone in his body, was named after Nathan Bedford Forrest, the first grand wizard of the Ku Klux Klan. Artistic irony is not something that works on the left.

For another example of the left’s humor deficit, President Trump retweeted an adorable Carpe Donktum video riffing off a viral video from last September showing two toddlers, one black and one white, embracing each other before running off to play. You can easily see how Carpe Donktum played with the video. He’s not secretly manipulating anything:

Twitter’s police, unable to understand humor, slapped a “manipulated media” warning on the video. This is what four (or six or seven) years in an American college does to people’s brains.

The CEO of Chick-fil-A says that white people need to polish black people’s shoes to show a sense of shame and racism – and he’s bought shoe polish bushes for his Chick-fil-A employees:

I stopped eating at Chick-fil-A when we learned that it handed its multi-million-dollar foundation to an uber-leftist. Founder S. Truett Cathy was a conservative, but it’s beginning to look as if Chick-fil-A’s “closed on Sunday” rule is a marketing scam to hide from the public the company’s leftward tilt.

Antifa uses an inverted red triangle in its iconography. That’s why the Trump team used an inverted red triangle in an ad attacking Antifa. Facebook took the ad down because the Nazis used red triangles on prisoners.

The logic is that because the Nazis used triangles, Trump is a Nazi. This flawed syllogism may explain the Democrats’ hostility to Israel: Israel’s symbol is a Star of David; the Nazis made people wear Stars of David; therefore, Israel is a Nazi country. I wonder how many vegetarians on the left know that Hitler was a vegetarian….

Garrett Rolfe was the police officer who shot and killed Rayshard Brooks after Brooks attacked Rolfe and his partner, stole a taser, and then fired the taser at Rolfe. Naturally, Equity Prime Mortgage in Atlanta, Georgia, had to fire Rolfe’s stepmother from her job. It’s a common totalitarian tactic to destroy an entire family if one member runs afoul of the regime.

Nancy Pelosi ordered the removal of four portraits of 19th century Democrat Speakers of the House. Did I mention that they all served in the Confederacy? James Wood asked why she stopped with the 19th century:

This is just a small sampling of one day’s worth of stories. The Left has gone mad. If we’re to save America from heading down a totalitarian path, America’s silent majority needs to stand up to cancel culture and the woke mob.

Blue State Blues: Rename the Democratic Party

The Democratic Party is a relic of slavery, Jim Crow, and racism, and should be renamed as a gesture toward achieving social justice in the United States.

Moreover, it cannot even be said to be “democratic” — small “d” — anymore. It does not recognize the outcome of elections that it does not win, and it uses street violence to pressure the country’s leaders and entrepreneurs to do what it wants. And what the party wants is redistribution of wealth, income, and opportunity.

There is a word for that: “socialism.”

As I note in my forthcoming book, Red November, the Democratic Party’s transition to socialism is well under way.

Party leaders have maneuvered, in two successive elections, to ensure that Sen. Bernie Sanders (I-VT) — who is honest about the fact that he is a socialist — cannot be its nominee for the White House.

But even as it has rejected Sanders, the party has embraced his ideas. And, given the opportunity in November, Democrats will bring socialism to the United States.

More than half of Democrats think America should “defund the police” and redistribute the money to “communities of color” and the poor. More than three-quarters support the “Green New Deal,” which aims to eliminate fossil fuels in the next ten years. Likewise, over three-fourths of Democrats support “Medicare for All” — the mandatory kind, not just the optional one.

These policies were almost unthinkable just a few years ago. Today they are the mainstream view in a party that prefers socialism to capitalism as an economic system.

We have just endured the most left-wing primary in the history of American policies, producing the most left-wing nominee. Biden was cast as a “moderate,” but that was only relative to Sanders.

As FiveThirtyEight.com noted, Biden, if elected, would be the “most liberal president in modern U.S. history.” Obama himself says Biden has “the most progressive platform of any major party nominee in history,” including himself.

Even though he has secured enough delegates to win his party’s nomination, Biden continues moving to the left — unlike most candidate, who pivot to the center.

The New York Times noted last month that Biden “is striking fewer of the moderate notes that won him the nomination, instead courting progressives with a new openness to systemic disruption.” The Washington Post agrees, reporting earlier this month that Biden has begun to map out a “revolutionary” agenda.

Biden is collecting far-left advisers, including “democratic socialist” Rep. Alexandria Ocasio-Cortez (D-NY). He is also echoing the “transformative” rhetoric of Obama and Sanders.

He told a group of Latino leaders last month: “I truly think, if we do this right, we have an incredible opportunity to not just dig out of this crisis, but to fundamentally transform the country.”

That is not the “moderate” agenda of a traditional New Deal Democrat. It is the battle cry of socialism.

Democrats are attached to the “Democratic” label. They certainly prefer it to “Democrat Party,” a rough-sounding label conservative media often use. The word “democratic” has positive connotations of popular sovereignty and freedom.

But while “democratic” is good, “Democratic,” capital “D,” has not been good. All of the Confederate statues being torn down in the South? They were all Democrats. The segregationists Biden courted as a junior Senator? Also Democrats.

In contrast, “Republicans” are still “republican,” believing fundamentally in the principles of the Constitution and the primacy of representative government, balanced by individual liberties.

It is time to rename the Democratic Party.

The long arc of justice, as well as the basic principle of truth in advertising, demands no less.

There already is a tiny Socialist Party, and the Democratic Socialists of America.

So pick another name. And close the book on a sad history of systemic racism.

Fauci falls, fumbles forbidding football

It’s been a long way down for Anthony Fauci, MD – from virtual dictator of a nation under virtual house arrest (and purported sex symbol) to laughingstock caught lying and blaming the public for his fall.

Fauci finally fessed up to his face mask fabulations. He lied to us for our own good, of course.  

When the coronavirus pandemic hit stateside, face masks were strictly recommended as personal protective equipment (PPE) for health care professionals. According to Anthony Fauci, the nation’s leading infectious disease expert and a key member of the White House coronavirus task force, masks weren’t advised to the public from the start because of the anticipated PPE shortages.

Got that? You weren’t supposed to wear a mask – not because they were ineffective, but because other people needed them more. But now that they are widely available, why you should wear them. In fact, you are required to wear them many places.

Now, Fauci is complaining that ignorant Americans “don’t believe science and they don’t believe authority.”

“One of the problems we face in the United States is that unfortunately, there is a combination of an anti-science bias that people are — for reasons that sometimes are, you know, inconceivable and not understandable — they just don’t believe science and they don’t believe authority,” Fauci told the Learning Curve podcast, which is produced by the Department of Health and Human Services (HHS).

“So when they see someone up in the White House, which has an air of authority to it, who’s talking about science, that there are some people who just don’t believe that — and that’s unfortunate because, you know, science is truth,” Fauci continued, referring to the White House coronavirus task force’s once-daily briefings.

Ahem: real science is a work in progress, a hypothesis that explains the data, and always subject to further revision when new data is available. The claim “science is truth” is a religious statement.  

This is part of the progressive narrative that Trump and the rest of us deplorables are “anti-science.” This, from those who are on the political team that thinks there are multiple genders and that you can switch genders if (1) you believe it, (2) you pump enough hormones into your system, and/or (3) you physically mutilate yourself.

 As for not believing in authority (not that “believing” is even the right term, but ok), how does he explain all of us following lock down orders like a bunch of sheep? His lies, and the phony models used to justify the mass house arrest have forfeited the respect that formerly existed.

As a result, his announcement that “football may not happen” is meeting outright defiance from the NFL

The NFL responded Thursday to Dr. Anthony Fauci saying football might not happen this year unless players are in a bubble, doubling down that it plans to play the 2020 season as scheduled.

“Dr. Fauci has identified the important health and safety issues we and the NFL Players Association, together with our joint medical advisors, are addressing to mitigate the health risk to players, coaches and other essential personnel,‘’ Dr. Allen Sills, NFL Chief Medical Officer, said in a statement from the league. “We are developing a comprehensive and rapid-result testing program and rigorous protocols that call for a shared responsibility from everyone inside our football ecosystem. This is based on the collective guidance of public health officials, including the White House task force, the CDC, infectious disease experts, and other sports leagues.‘’

Fauci and the phony models have discredited more than one man. The global warming fraud, totally a product of computer models, is now a much harder sell.

NBC News Gets Wrecked Over Botched Story About Conservative Publication

Well, it looks like NBC News’ Verification Center tried to go after conservative news sites and ended up peddling fake news instead. It comes after a story they pushed claiming that Google has demonetized The Federalist. Yet, Google denied they did any such thing, even refuting it on their Twitter account. This forced NBC News to edit their piece:

Google has banned ZeroHedge, a far-right website that often traffics in conspiracy theories, from its advertising platform over policy violations found in the comments section of stories about recent Black Lives Matter protests.

Google also issued a warning on Tuesday to The Federalist over comments on articles related to recent protests.
A Google spokesperson said in an email on Monday that it demonetized the websites after determining they violated its policies on content related to race.

“We have strict publisher policies that govern the content ads can run on and explicitly prohibit derogatory content that promotes hatred, intolerance, violence or discrimination based on race from monetizing,” the spokesperson wrote. “When a page or site violates our policies, we take action. In this case, we’ve removed both sites’ ability to monetize with Google.”

After publication of this story, Google backtracked Tuesday, clarifying that The Federalist had been warned about policy violations but still had time to address them.

Far Left Defense Official Sentenced to 30 Months in Prison for Leaking Classified Information to Journalists

The Justice Department in October announced the arrest of 31-year-old Henry Kyle Frese, a (now former) Defense Intelligence Agency employee, for leaking to journalists.

Frese pleaded guilty to charges related to his disclosure of classified national defense information (NDI) to two journalists in 2018 and 2019, the DOJ announced in February of this year.

On Thursday, Frese, who had faced up to 10 years behind bars, was sentenced to 30 months in prison.

“When our nation’s secrets are published, in print or online, those secrets are made available to all of our adversaries,” said G. Zachary Terwilliger, U.S. attorney for the Eastern District of Virginia. “Frese’s choice to betray his oath to his country had real consequences and caused actual harm to the safety of this country and its citizens.”

Henry Kyle Frese of Virginia, a far left radical, was hit with two counts of willful transmission of national defense information.

According to the DOJ, Frese lived with, and had a romantic relationship with one of the reporters he was transmitting top secret information to in 2018 and 2019.

Mr. Frese reportedly leaked classified information to Amanda Macias, a CNBC national security reporter.

Frese gave Ms. Macias classified intelligence information that she and NBC News later used in reports on North Korea’s weapons systems, according to journalist Matthew Keys.

“In or about mid-April to early May 2018, FRESE accessed an intelligence report unrelated to his job duties on multiple occasions, which contained NDI classified at the TOP SECRET/SCI level, which related to a certain foreign country’s weapons systems,” the indictment said.

According to the indictment, Frese stated he was “down” to help the journalist who contacted him via Twitter direct message because “he wanted to see the journalist progress.”

“Frese violated the trust placed in him by the American people when he disclosed sensitive national security information for personal gain,” said Assistant Attorney General for National Security John C. Demers. “He alerted our country’s adversaries to sensitive national defense information, putting the nation’s security at risk.  The government takes these breaches seriously and will use all the resources at our disposal to apprehend and prosecute those who jeopardize the safety of this country and its citizens.”

Good riddance!

Five days after hundreds of protesters swarmed the outside of her Broadmoor home demanding support for hospitality workers, New Orleans Mayor LaToya Cantrell issued a scathing rebuke of their actions, saying they scared her daughter and should take their concerns to state lawmakers.

In an open letter released late Tuesday, Cantrell praised the Black Lives Matter movement that has inspired protests across the nation in the wake of the police killing of George Floyd, but condemned demonstrators who used the movement’s rallying cry when they converged on her home.
