Judge denies Parler’s request to force Amazon to reinstate website services

The social media platform Parler lost a bid for a court order to force Amazon to reinstate their website services.

Amazon banned Parler from their web host servers on Jan. 9 over what they claimed was a "steady increase" in "violent content" that was against their terms of service. Parler’s CEO John Matze accused the tech industry of colluding in order to squeeze competition out of the marketplace, and filed a lawsuit against Amazon days later.

Attorneys for Parler requested a preliminary injunction from the court and argued in part that Amazon was violating laws against monopoly in favor of Twitter, Parler’s competitor.

U.S. District Court Judge Barbara Rothstein said in her decision on Thursday that Parler had not proven that it was likely to succeed against Amazon, and was not entitled to an injunction that would return the website services to the platform.

"The likelihood of Parler prevailing on its claims is not a close call. Parler’s allegations at this time are both inaccurate and unsupported, and are disputed by evidence submitted by [Amazon]," said Rothstein.

Rothstein found the connection between Parler’s suspension and Twitter tenuous since Amazon doesn’t have the same relationship with Twitter as it does with Parler.

"Parler has failed to do more than raise the specter of preferential treatment of Twitter by [Amazon]," said Rothstein. "Parler and Twitter are not similarly situated, because [Amazon] does not provide online hosting services to Twitter."

Rothstein also rejected the argument from Parler that reinstating their social media platform was in the public interest.

"The Court explicitly rejects any suggestion that the balance of equities or the public interest favors obligating [Amazon] to host the kind of abusive, violent content at issue in this case, particularly in light of the recent riots at the U.S. Capitol," said Rothstein.

"That event was a tragic reminder that inflammatory rhetoric can — more swiftly and easily than many of us would have hoped — turn a lawful protest into a violent insurrection," she added. "The Court rejects any suggestion that the public interest favors requiring [Amazon] to host the incendiary speech that the record shows some of Parler’s users have engaged in."

Rothstein was nominated to the court by former President Jimmy Carter in 1979.

The ruling leaves the future of the social media platform in question, though Matze has promised that the service will return.

Twitter refused to take down widely shared pornographic images and videos of a teenage sex trafficking victim because an investigation “didn’t find a violation” of the company’s “policies,” a scathing lawsuit alleges.

The federal suit, filed Wednesday by the victim and his mother in the Northern District of California, alleges Twitter made money off the clips, which showed a 13-year-old engaged in sex acts and are a form of child sexual abuse material, or child porn, the suit states.

The teen — who is now 17 and lives in Florida — is identified only as John Doe and was between 13 and 14 years old when sex traffickers, posing as a 16-year-old female classmate, started chatting with him on Snapchat, the suit alleges.

Senate Dems File Ethics Complaint Against Cruz, Hawley For Objecting To Electoral Results

Congressional Democrats – who objected to the electoral results for the last three GOP presidents – have filed an ethics complaint against GOP Senators. Ted Cruz (TX) and Josh Hawley (MO) for objecting to the Electoral College results.

"The Senate Ethics Committee should investigate their conduct to fully understand their role. The actions of which we know demand an investigation and a determination whether disciplinary action is warranted. Until then, a cloud of uncertainty will hang over them and over this body," wrote Democratic Sens. Sheldon Whitehouse (RI), Ron Wyden (OR), Tima Smith (MN), Richard Blumenthal (CT), Mazie Hirono (HI), Tim Kaine (VA) and Sherrod Brown (OH).

The complaint wants the Ethics Committee to investigate whether Cruz and Hawley failed to "[p]ut loyalty to the highest moral principles and to country above loyalty to persons, party, or Government department," or if they engaged in "improper conduct reflecting on the Senate" linked to the January 6 Capitol ‘riot.’

The Democratic senators also outlined several questions they believed should be probed as part of an Ethics Committee investigation including if they were in touch with coordinators for the rally, if they encouraged any “insurrectionist” acts or if they “engaged in criminal conduct, or unethical or improper behavior.”

“While it was within Senators’ rights to object to the electors, the conduct of Senators Cruz and Hawley, and potentially others, went beyond that,” they wrote in the letter to Ethics Committee leadership. 

Cruz and Hawley, two potential 2024 presidential contenders, have denounced the mob that breached the Capitol but they’ve also stood by their decisions to object to the Electoral College results from Arizona and Pennsylvania, respectively. –The Hill

During the counting of electoral votes, Cruz objected to Arizona’s results, while Hawley objected to Pennsylvania’s results following the Capitol attack, when a group of Trump supporters and at least one prominent member of BLM breached the Capitol building and occupied it for a brief period of time before leaving on their own.

The Democratic Senators are also asking the Ethics Committee to "offer recommendations for strong disciplinary action, including up to expulsion or censure, if warranted by the facts uncovered."

Rep. Marjorie Greene officially files articles of impeachment against President Biden

Freshman GOP Rep. Marjorie Taylor Greene of Georgia officially filed articles of impeachment Thursday against President Joe Biden on his first full day in office, following through on a promise she made Jan. 13 when the House voted to impeach then-President Donald Trump a second time.

Greene confirmed the filing on Twitter, telling her followers, "We’ll see how it goes," before releasing a written statement on her action.

In a press release, Greene’s office stated that the Georgia Republican introduced articles of impeachment against Biden "for his corrupt actions involving his quid pro quo in Ukraine and his abuse of power by allowing his son, Hunter Biden, to siphon off cash from America’s greatest enemies Russian and China."

"President Joe Biden is unfit to hold the office of the Presidency," the congresswoman wrote, arguing:

"His pattern of abuse of power as President Obama’s Vice President is lengthy and disturbing. President Biden has demonstrated that he will do whatever it takes to bail out his son, Hunter, and line his family’s pockets with case from corrupt foreign energy companies.

President Biden is even on tape admitting to a quid pro quo with the Ukrainian government threatening to withhold $1,000,000,000 in foreign aid if they did not do his bidding. President Biden residing in the White House is a threat to national security and he must be immediately impeached."

Greene went on to list allegations in what she referred to as the "vast and detailed" case against Biden.

Greene was asked by Newsmax prior the filing if her impeachment efforts against Biden were merely symbolic, given that Democrats control the House of Representatives. Her office later told TheBlaze that "Rep. Greene simply wants to be a voice for the voiceless," saying the congresswoman "wants to defend [American conservatives] and represent the Silent Majority."

Greene, a strong supporter of President Donald Trump, won election on Nov. 3 in Georgia’s 14th District and has already made a string of headlines since taking office.

The congresswoman was temporarily suspended from Twitter last week after the social media platform accused her of "multiple violations of our civic integrity police." But Greene argued in response that she was given no explanation for the suspension, and issued a statement saying that "big tech is silencing Americans" and that "censorship has got to stop."

Greene is also facing criticism after an unearthed social media post from 2018 showed that she referred to the Parkland, Florida, school massacre that killed at least 17 people as a "false flag."

Tennessee mayor lowers town’s American flag on day of Biden inauguration, sparks massive criticism. But he’s sticking to his guns.

A Tennessee mayor lowered his town’s American flag to half-staff in mourning for the country on the day of President Joe Biden’s inauguration. He posted about lowering the flag on Facebook.

While many critics accused him of trying to incite anger with the post, the mayor insisted that his post had nothing to do with Biden’s inauguration.

Bruceton Mayor Robert T. Keeton III announced Wednesday that the town is grieving for the nation for various reasons.

In the Facebook post, Keeton wrote, "The Town of Bruceton grieves for our Republic and our loss of freedoms. We mourn the victims of the Chinese plague and those that have suffered its depredations. We pray that God delivers and restores us and that we do not fall to the clutches of communism."

Keeton’s Facebook post drew a plethora of attention, which forced him on Thursday to clarify the intent of the original posting, which remains active at the time of this reporting.

As highlighted by WSMV-TV, one commenter wrote, "This is one of the most unpatriotic things I have ever seen. As friends and neighbors die from COVID and our nation hurts, you use the town page to air your personal grievances? This is not the way to promote Bruceton as a nice place to live. Shame on you."

Another critic added, "This is a slap in the face of all of our military heroes and leaders who have sacrificed their lives for this country. That’s why we lower the flag. Mayor, you’re placing the importance of your own personal, childish pouting on the same level with the men and women who have died fighting for you. This is shameless. I’m embarrassed for my friends who live in Bruceton."

"This is a flagrant incitement of anger and disunity on a public platform," another person added. "The mayor is not The Town of Bruceton. Was this statement approved by the city council? It seems like it is pandering to the worst characteristics of human nature. I expect better of my elected representatives."

Keeton fires back

The Jackson Sun reported that Keeton, also a lawyer, said that the post was "just a commentary and prayer for our country."

"I’m an attorney, and I’m seeing our constitutional rights being trampled on virtually every day, and I’m concerned for our republic, even though I’ve lost people that I know to this Chinese virus," he explained.

The outlet added, "Keeton said he’s concerned with what he’s seeing in the country starting with social media platforms not allowing certain communication to remain on their sites. Twitter and Facebook recently banned former President Donald Trump from posting on their sites in the final two weeks of his presidency, and Apple and Google removed the social media platform Parler – which had become a site many conservatives were going to once they felt they were being censored on Facebook and Twitter – from being available to download and access through their platforms."

He proclaimed, "That’s not right, and the government isn’t doing anything about it. And I was raised that everyone had the right to say what they wanted to, and if someone disagreed with you, then that’s the way it is."

Keeton added that the lowering of the flag had nothing to do with Biden’s inauguration.

“If anyone thinks this was because of the inauguration happening today or anything else, it’s not," Keeton insisted. “We had a man in his mid-60s who called up to City Hall from the nursing home that died yesterday from the virus. He was in the nursing home alone and he died alone, and my post was a reaction to that and everything that’s happened because of it."

Bruceton had a population of 1,478 in the 2010 census, the Sun reported.
