Democrats slip sneaky little rider into stimulus bill to forbid states from cutting taxes


The Democrats’ $1.9 trillion stimulus bill is a monster of public spending with the prime aim of rewarding political cronies. Free-spending blue cities and states get bailouts, along with unions with mismanaged gold-plated pensions for their members. The losers, of course, are the savers and taxpayers. That’s because it won’t be long before Argentina-style inflation and Europe-style taxes kick in to pay for these benefits to leftists.

The only hope is to grow the economy so that the debt can be paid, which is something Americans often know how to do.

But unlike other bills, this one contains a poison pill, to ensure that red states and cities inclined to cut taxes are stopped dead in their tracks.

Reason magazine’s Eric Boehm has located and identified this slimy, sneaky little rider:

Buried within the $1.9 trillion emergency spending bill that Congress sent to President Joe Biden’s desk on Wednesday is a provision that could effectively block states from cutting taxes if they accept federal bailout dollars.

That provision, added to the bill by the Senate last week, could put a halt to several states’ plans to cut taxes this year as a way to stimulate economic growth following the COVID-19 pandemic. Depending on how the text is interpreted, the measure could also make it illegal for states to create new tax credit programs like the ones that have become a popular mechanism for expanding school choice. Critics say this expansion of federal control over state policymaking is murky at best, and potentially unconstitutional.

Darn right, it’s unconstitutional. If a state can’t cut taxes, what exactly can it do? 

It amounts to a Democrat bid to not just shovel other people’s money, but that little thing that comes with money, which is control. Conditionality. Power. In exchange for passing this monopartisan spending bill, their aim is not just to bail out blue cities and states at the expense of red ones, but to make red cities and states as overtaxed and badly run as blue ones.

And don’t think this isn’t an issue. Democrat-run blue states are hemorrhaging people. The COVID lockdowns have cut the benefits of living in big blue cities by shutting down all economic and social activity and forcing workers into their homes. A lot are realizing they don’t need to work in giant cities any more, so the crime and high taxes they pay are starting to matter. 

According to this January 2020 editorial in the Wall Street Journal:

 Four states have lost population since 2010 including West Virginia (-3.3%), Illinois (-1.2%), Vermont (-0.3%) and Connecticut (-0.2%), but 10 experienced declines last year. New York was the biggest loser as a net 180,000 people left for better climes. Over the last decade New York has lost more of its population to other states (7.2%) than any other save Alaska (8%), followed by Illinois (6.8%), Connecticut (5.6%) and New Jersey (5.5%).

Hmmm, what do these states have in common? Large tax burdens and politically powerful public unions. Illinois’s property tax rates are the second highest in the country after New Jersey. The state lost $5.6 billion in adjusted gross income last year to other states, about twice as much as in 2012. Notably, income outflow hasn’t increased from Michigan or Wisconsin.

And when businesses and people flee these blue states, Democrats actually cheer. Remember this toad from California, who used filthy language to urge California’s last remaining car manufacturer, eco-friendly Tesla, no less, to flee with good riddance? These creatures are out there, and they say what they think. Democrats often claim they’re happy to see people fleeing their states and enact no policies to stop it, but the partying stops when they realize the consquences: Lost congressional seats. They don’t say so openly, but that little issue concentrates their minds. So what better than to stop the low taxes that are bringing blue-state population into red states? Make them all as badly run as blue states so no one will flee? That’s what is behind this creepy little embedded rider in this monstrous spending measure.

It’s a slimy little conditionality that has no basis in constitutional law. No more laboratory of the states, it seems, with one showing the others what to do if one values prosperity, and another showing what not to do. They want all the states to be run the same — like Democrat blue states, with nobody having any reason left to flee.

It’s a upside down economics for sure. Because just as cronies are rewarded for their bad behavior, ensuring more of it, well run red states who are paying for this are being hit with conditionality as if they’re the ones who’ve done something bad.

In normal economies, badly run blue cities and states getting bailouts should be the ones subject to conditionality, such as ‘live within your means,;  just as badly run or speculator-hit nations under the thumb of IMF money are subject to such conditions in exchange for their bailouts, but in this upside-down bailout, the opposite is the case.

Red states that cut taxes are subject to conditionality, not blue ones. Blue ones are set to party hearty and continue the same free-spending ways that got them into trouble in the first place. For leftists, that’s virtue rewarded.

Economically ravaged red states should challenge the hell out of this vile power grab to end the laboratory of the states. After all, since red states contribute mightily to this leftist bailout pot, they have a right to have some share in how this money is distributed. The alternative is for every red city to become Portland, New York or Minneapolis, and every red state to become New York, Illinois, or California. These red cities and states should proceed carefully as they challenge this, avoiding emotion-laden issues such as school choice (which will bring out the our-children-are-in-danger ads from powerful money-larded teachers unions) and focus on some aspect of their economies, (such as tax cuts for small business) that teachers’ unions can’t counter. That will allow the courts to rule on this pork bill’s constitutionality rather than ride the polls and Democrat narratives, given the weakness of our judges.

Democrats have tried this kind of our-law-is-permanent stuff before and two instances spring to mind: One is the Harry Reid rider in the original 2010 Obamacare passage which claimed no state can repeal the passage of the detested mono-partisan law on its death panels, which the San Francisco Examiner blasted in this editorial.

The other is the blue states’ claim to sanctuary cities and states, claiming to override federal law as if no federal law ever mattered. In this legal discussion, the lawyers bring up that judges often ruled that Congress needed to pass laws to enforce federal  law, instead of enforcement by feds with executive orders. But that ignores the baseline federal immigration laws themselves, which were passed by Congress in the first place.

If nothing else, the whole thing shows the Democrats’ full blown hypocrisy on whether the feds or the states have the control. If cities and states are blue, they have control., if they are red, the feds have control. Thats their position. And this slimy little power grab against red cities and states should be challenged in every court, because it’s nothing but a power grab.

In a rare moment of truth of CNN Wednesday, Anthony Fauci admitted that there is no scientific reason why people who have had the COVID vaccine are still having their freedoms restricted.

CNN host John Berman asked Fauci “What’s the science behind not saying it’s safe for people who have been vaccinated – received two doses, to travel?”

“When you don’t have the data and you don’t have the actual evidence, you’ve got to make a judgment call,” Fauci replied, declaring that Americans will just have to trust the CDC:

As we reported this week, CNN announced that the CDC is graciously allowing vaccinated Americans some ‘limited freedoms’, prompting a huge backlash on social media where people pointed out that the health body doesn’t grant anyone their God given freedoms.

So, there is no science and the CDC is making a judgement call about how ‘free’ Americans can be. Hmmm.

All this comes as a little-remarked new study from the Centers for Disease Control and Prevention, the very epicenter of the pro-lockdown public health establishment, found the positive effects from mask-wearing were decidedly modest in scale.

"Part of the problem for Dr. Fauci," Stanford University Professor of Medicine Jay Bhattacharya said, "is that he is blind to the harms of the lockdown … He seems not to understand that the lockdown creates all kinds of physical problems, psychological problems, harms that I’ve never seen him talk about."

Rep. Madison Cawthorn (R-NC) used floor debate Wednesday to call out Democrats’ proposed gun grab and said if they want his they will need to “come and take them.”

Cawthorn said, “I want to remind my colleagues of a simple fact that is far too often swept under the rug by the left: Americans have a right to obtain firearms for lawful purposes.”

He added, “Let me be clear to everyone in this chamber, you will not take this right away from us. I know it’s easy to be sucked into the DC bubble, but outside of here, in real America, when we say ‘Come and Take It,’ we damn well mean it.”

Cawthorn then criticized the left’s blind pursuit of gun control, warning, “If you think this bastardization of the Constitution will be met with silence you know nothing of the America I know. You want my guns, I know it, we all know it. Well Mr. Speaker, you can come and take them.”

Hours after the House passed a bill allowing for unlimited delays for FBI background checks, and Senate Majority Leader Chuck Schumer revived a House-passed bill requiring background checks for private firearms sales, Sen. Dianne Feinstein (D-CA) announced that she would soon ‘work with her Senate colleagues’ to pass other reforms – including an assault weapons ban – in the coming weeks.

It’s unclear which features on scary black rifles that are functionally equivalent to any hunting rifle will be off-limits.

Washington—Senator Dial.. Feinstein (D-Calif) today released the following statement in support of the Back,ound Check Expansion Act, Senator Chris Murphy’s (D-Conn) bill to require background checks on all gun sales and transfers:

"Universal background checks are a commonsense approach to address the gun violence epidemic plaguing our country. I’m proud to support the Background Check Expansion Act and look forward to passing it and other much-needed reforms.

“This bill would require background checks on all gun sales and transfers, including for private and unlicensed sales for which they are not currently required. This is one of the best ways to ensure guns won’t fall into the hands of dangerous people.

“The majority of Americans want universal background checks. A 2019 Washington Post-ABC News poll found that 89 percent of Americans support background checks for all potential gun purchases.

“*I look forward to working with my Senate colleagues to pass this bill and other reforms, including the assault weapons ban that I plan to introduce in the coming weeks*. Commonsense bills to combat gun violence have been introduced in the House and with a new administration in the White House, it’s time to take action to end gun violence."

House Majority Leader Chuck Schumer (D-NY) vowed on Thursday to reintroduce gun reform legislation, while the House passed a second bill aimed at background checks within the last hour.

"No more hopes and prayers, thoughts and prayers—a vote is what we need," said Schumer, vowing to bring a bill, H.R. 8, out of former Majority Leader Mitch McConnell’s ‘legislative graveyard’ after it stalled in the Senate in early 2019 after passing through the Democrat-controlled House of Representatives.

H.R.8 is the latest version of Democrats’ so-called "Universal Background Checks."

Currently, any gun purchased at a retail store, or online, must go through a background check and involved a licensed firearms dealer (FFL). H.R.8 requires background checks for private sales.

"The idea that this is going to make us safer is laughable," said Rep. Mary Miller (R-IL). "Criminals looking to get their hands on firearms to use in crimes are not going to submit to background checks. Only law-abiding citizens will follow the law. This is a back door means of setting up a national registry of firearms – something I completely oppose."

"The problem with gun violence is not that we don’t have enough gun laws," Miller continued. "We have enough gun laws. What we need is to make sure the laws we have are enforced. Look at what happened in 2019 in Aurora when five people were shot and killed. The shooter had moved to Illinois from another state and because his background information was not updated – he was allowed to get a FOID card in Illinois and purchase firearms. Then when he applied for a conceal carry permit, his criminal background was discovered and his FOID card was revoked but his guns were never surrendered as required by law. If the gun laws had been enforced – a terrible tragedy could have been avoided. We need better enforcement – not more laws. Instead of passing terrible legislation like H.R. 8, we need to do a better job of providing law enforcement agencies with the resources they need to enforce existing gun laws."

The reintroduction of H.R.8 was spearheaded by Democratic Rep. Mike Thompson, who chairs the House Gun Violence Prevention Task Force. He was joined by House Democrats Jerry Nadler (NY), Sheila Jackson Lee (TX), Robin Kelly (IL) and Lucy McBath (GA), and were joined by Republican Reps. Fred Upton (MI), Christopher Smith (NJ) ad Brian Fitzpatrick (PA).

According to a summary of the bill, its goal is to "utilize the current background checks process in the United States to ensure individuals prohibited from gun possession are not able to obtain firearms."

Meanwhile, the House just passed H.R. 1446, which would allow for indefinite delays for FBI background checks, as opposed to the three-day default transfer window. Introduced by Democratic Rep. Jim Clyburn (SC), the Enhanced Background Checks Act of 2021 would close down the so-called "Charleston Loophole" which allowed some gun sales to go through before the required background check is complete.

Of note, there’s been a 22.8% increase in FBI background checks y/y.

Mexico ‘Worried’ That Biden Is ‘Stoking Illegal Immigration,’ ‘Creating Business For Organized Crime’: Report

Mexico’s left-wing government is reportedly concerned that Democrat President Joe Biden’s policies are sparking a massive surge in illegal immigration to the U.S. and are providing business for the nation’s violent drug cartels.

Reuters reported this week that, according to government officials and reports, Mexico is “worried the new U.S. administration’s asylum policies are stoking illegal immigration and creating business for organized crime.” Biden’s policies have already significantly impacted the border situation as more than 100,000 migrants were detained last month for illegally trying to enter the U.S., the highest total for the month of February since 2006.

“They see him as the migrant president, and so many feel they’re going to reach the United States,” Mexican President Andres Manuel Lopez Obrador said of Biden. “We need to work together to regulate the flow, because this business can’t be tackled from one day to the next.”

The report said that Mexican intelligence has found that the cartels are “diversifying methods of smuggling and winning clients as they eye U.S. measures that will ‘incentivize migration.’”

Some key takeaways from the report include:

  • U.S. policies that Mexican officials believe are driving the criminal activity include “support for victims of gangs and violence, streamlining of the legalization process, and suspension of Trump-era accords that deported people to Central America.”
  • The Mexican cartels changed their modus operandi “from the day Biden took office” and are now showing “unprecedented” levels of sophistication in their criminal activity, which includes “briefing clients on the latest immigration rules, using technology to outfox authorities, and disguising smuggling operations as travel agencies.” The smugglers communicate with the migrants on numerous social media channels to update them on “impending checkpoints, when freight trains they can jump on pass, where to stay and how to navigate immigration laws.”
  • Those trying to enter the U.S. are now traveling in smaller groups and are taking less traveled routes to avoid detection, routes the report said were even more dangerous than the other ones.
  • The smugglers are telling the migrants to go to their local authorities and make complaints that they have been the victims of crime that way they can apply for asylum in the U.S. and the migrants are being told to bring children so it is easier for them to apply for asylum.
  • To ease their passage, smugglers advise Central American clients to register complaints with authorities saying they have been victims of extortion or, for young men, that they have faced death threats from street gangs, the assessments show.
  • Mexico is also concerned that “there could be a significant influx in migrants from outside the region – the Caribbean, Asia, Africa and the Middle East – as coronavirus-led border restrictions begin easing.”

The Washington Post reported this week that the scale of Biden’s border crisis is so severe that his administration is “holding record numbers of unaccompanied migrant teens and children in detention cells for far longer than legally allowed” and federal health officials have fallen “further behind in their race to find space for them in shelters.”

7 European Nations Halt AstraZeneca Jabs On Reports Of "Serious" Blood Clots

Update (0820ET): More countries have followed Denmark by suspending approval of the AstraZeneca-Oxford COVID vaccine. Norway, Denmark, Estonia, Lithuania, Luxembourg, Latvia, and Italy have now opted to halt use of the vaccine, creating more problems for Europe’s sluggish vaccine rollout.

The halts follow incidents involving blood clots in patients who recently received the vaccine. Two incidents were reported in Austria, although Vienna is allowing the vaccine to continue to be used, at least for now. Serious cases of blood clotshave been reported in Denmark and other countries as well.

Writer and skeptic Alex Berenson noted in a tweet that the AZ jab isn’t the only COVID shot suspected of causing harmful side effects in a small number of patients.

In a tweet confirming the suspension, Denmark’s health minister said there’s currently no way to know for certain whether the cases of serious blood clots are connected to the vaccine, but the situation certainly warrants ore investigation. "We acted early, it needs to be thoroughly investigated," he said.

Just days ago, Italian PM Mario Draghi halted a shipment of AstraZeneca jabs to Australia, marking the first time an EU leader invoked rules to prioritize domestic vaccine access. Now, Italian authorities are suspending vaccinations from a current batch of the AstraZeneca jab following a pair of suspicious deaths.

Meanwhile, health authorities in Brussels and London have dismissed these concerns, insisting that the AZ jab is safe, while moving ahead with plans to approve Johnson & Johnson’s single-dose jab.

The EU medicines regulator said it was recommending the vaccine be authorized for all adults over 18 "after a thorough evaluation" of JNJ’s data found the vaccine met the criteria for efficacy, safety and quality. The JNJ jab is the fourth to be licensed for use inside the EU.

Europe’s much-criticized vaccination rollout has just hit another snag, as Danish health authorities are increasingly concerned about harmful side-effects believed to be associated with the AstraZeneca-Oxford jab, the cheap COVID remedy that was supposed to help Europe catch up with the US, UK and Israel.

Danish authorities on Thursday temporarily suspended AstraZeneca’s COVID-19 shot following reports of cases of dangerous blood clots forming inside patients, including one such incident that took place in Denmark. Authorities didn’t specify exactly how many reports of blood clots there had been, but Reuters reports that Austria has also stopped using a batch of AstraZeneca shots while investigating a death attributed to coagulation disorders, along with an illness attributed ot a pulmonary embolism, a condition where one or more of the lung’s arteries becomes blocked by a blood clot. Six other European countries have also reportedly halted distribution of the COVID jab.

"Both we and the Danish Medicines Agency have to respond to reports of possible serious side-effects, both from Denmark and other European countries," the director of the Danish Health Authority, Soren Brostrom, said in a statement.

The Danish Medicines Agency said the suspension would last for 14 days as authorities launch an investigation into the blood clots, with assistance from other EU member states.

They did not say how many reports of blood clots there had been, but Austria has stopped using a batch of AstraZeneca shots while investigating a death from coagulation disorders and an illness from a pulmonary embolism.

AstraZeneca claims its vaccine is subject to strict and rigorous quality controls and that there have been "no confirmed serious adverse events associated with the vaccine." It said it was in contact with Austrian authorities and would fully support their investigation.

"Both we and the Danish Medicines Agency have to respond to reports of possible serious side-effects, both from Denmark and other European countries," the director of the Danish Health Authority, Soren Brostrom, said. "It is important to emphasize that we have not opted out of using the AstraZeneca vaccine, but that we are putting it on hold."

The European Medicines Agency said Wednesday there is no evidence linking AstraZeneca to the two cases of blood clots in Austria. The company said the number of (thromboembolic events" (blood clots forming) in people who have received the AstraZeneca vaccine is no higher than that seen in the general population, with 22 cases of such events being reported among the 3MM people who have received it as of March 9.

And at least one investor claimed Denmark’s suspension of AstraZeneca’s COVID vaccine on blood clot concerns shows "the detection systems that look for potential safety issues are working," and that most of these "safety events" would ultimately be linked to natural processes, not the jab.

"It’s good to see the safety signal detection systems working and it’s important that any safety signal is followed-up using the correct protocols,” Shore analyst Adam Barker told Bloomberg. Data from the vaccine’s phase three trials suggests that "you would expect that most safety signals won’t ultimately be linked to the vaccine,” he said.

However, "it’s hard to make judgments on the impact on shareholder value,” he added, given there are “a lot of moving parts." But ultimately, a risk-reward trade-off with any therapy; “you can only confidently make judgments on that decision when all the data is finalized and clear”

Nevertheless, shares of AZ tumbled on Thursday on signs that the European vaccine rollout is facing fresh skepticism and obstacles. Shares were down more than 2% in London’s mid-morning trade.

Whether Austria and other EU states will follow suit remains to be seen, though at least one other national health authority is reportedly considering a halt: the Norwegian Institute of Public Health and the Medicines Agency are meeting to discuss Denmark’s decision to halt vaccinations using doses of the vaccine, according to reports from state broadcaster NRK.

House Passes Democrat Bill Criminalizing Private Gun Sales


The U.S. House of Representatives passed universal background check gun control Thursday, criminalizing private gun sales conducted apart from an FBI background check.

The legislation, H.R. 8, sponsored by Rep. Mike Thompson (D-CA), passed by a vote of 227 to 203.

H.R. 8 would expand retail point-of-sale background checks so as to cover private points-of-sale. This will criminalize an individual who sells a 5-shot revolver to a lifelong neighbor, unless that neighbor first undergoes a National Instant Criminal Background Check System (NICS) check, conducted by the FBI.

On Wednesday, bill sponsor Thompson claimed, without evidence, his bill is supported by “90 percent of the American [people].”

H.R. 8 was passed by the House in early 2019 as well, but never taken up by the Republican-controlled Senate. Democrat gains in the current Senate suggest the legislation will be discussed this time around.
