The Supreme Court unanimously rejected Biden administration arguments in a case from Rhode Island that police should be allowed to enter homes without a warrant to seize handguns.

The ruling in the case, Caniglia v. Strom, court file 20-157, came May 17.

Erich Pratt, Senior Vice President of Gun Owners of America and the affiliated Gun Owners Foundation, praised the new decision.

“The Supreme Court today smacked down the hopes of gun grabbers across the nation,” Pratt said.

“The Michael Bloombergs of the world would have loved to see the Supreme Court grant police the authority to confiscate firearms without a warrant. But the Supreme Court unanimously ruled that the Fourth Amendment protections in the Bill of Rights protect gun owners from such invasions into their homes.”

Bloomberg, the billionaire former New York mayor, is an activist and major funder of gun-control groups.

The case came before the high court for oral argument two months ago as President Joe Biden and congressional Democrats began pressing for aggressive new restrictions on Second Amendment gun ownership rights, including controversial “red flag” laws, which allow gun seizures from law-abiding gun owners with limited due process, in the wake of highly publicized deadly mass shootings in March at a Boulder, Colorado, supermarket and at Atlanta-area spas.

Police generally cannot conduct searches of private property without consent or a warrant.

In Cady v. Dombrowski the Supreme Court held in 1973 that police may conduct warrantless searches related to “community caretaking functions,” but only for “vehicle accidents.” Since then, the principle has become “a catchall for a wide range of responsibilities that police officers must discharge aside from their criminal enforcement activities,” the 1st Circuit Court of Appeals stated in the Caniglia case.

The community caretaking doctrine holds that police don’t always operate as law enforcement officials investigating wrongdoing, but sometimes as caretakers to prevent harm in emergency situations.

Edward Caniglia has no criminal history and no record of violence. He had been married to his wife for 22 years when, on Aug. 20, 2015, they had a disagreement inside their Cranston, Rhode Island, home.

The argument escalated. He produced an unloaded gun and said, “Why don’t you just shoot me and get me out of my misery?”

Worried he might be suicidal, his wife asked police to conduct a welfare check. The husband went to a local hospital briefly after police assured him they wouldn’t take his two handguns.

After he left, they seized his guns without a warrant, telling the wife his life and others could be in danger if they left the guns in the home. The police refused to return the weapons and Caniglia sued, arguing the community caretaking exception should not apply inside “the home–the most protected of all private spaces.”

During telephonic oral arguments March 24, Department of Justice lawyer Morgan Ratner supported the city of Cranston’s position, arguing police have to be free to act in potential emergencies.

“Although there have been a lot of questions this morning about whether this is emergency aid or exigent circumstances or community caretaking or something else, the label you give it is not nearly as important as the principle. And the key principle is if someone is at risk of serious harm and it’s reasonable for officials to intervene now, that is enough,” Ratner said.

Writing the Supreme Court’s short, 4-page opinion in the case, Justice Clarence Thomas noted the Cady v. Dombrowski precedent, which he indicated applied to police “responding to disabled vehicles or investigating accidents.”

“The question today is whether Cady’s acknowledgment of these ‘caretaking’ duties creates a standalone doctrine that justifies warrantless searches and seizures in the home,” Thomas wrote.

“It does not,” he added.

Thomas wrote that the federal district court ruled in favor of the police and the 1st Circuit expanded on this, stating that police “often have noncriminal reasons to interact with motorists” on public highways. The appeals court “extrapolated” from the Cady ruling “a freestanding community-caretaking exception that applies to both cars and homes.”

The appeals court’s community caretaking rule “goes beyond anything this Court has recognized,” Thomas wrote.

The acknowledgement that “police officers perform many civic tasks in modern society was just that—a recognition that these tasks exist, and not an open-ended license to perform them anywhere.”

In a separate concurring opinion, Justice Samuel Alito wrote that the Supreme Court is “properly reject[ing] the broad ‘community caretaking’ theory.”

At the same time, he noted that the case implicates “another body of law that petitioner glossed over: the so-called ‘red flag’ laws that some States are now enacting.”

Such laws, he wrote, “enable the police to seize guns pursuant to a court order to prevent their use for suicide or the infliction of harm on innocent persons.”

Although this particular decision does not address those issues, “provisions of red flag laws may be challenged under the Fourth Amendment, and those cases may come before us.”

At press time, Acting U.S. Solicitor General Elizabeth Prelogar and Marc DeSisto, attorney for Cranston, had not responded to requests for comment from The Epoch Times.

A liberal knitting group called Stitchbug Studio is selling knitted penis prosthetics known as “soft packers” for children, noting that they serve the “trans and non-binary community.”

“Bitty Bug® soft packer is a custom prosthetic packer in youth sizes, made from soft durable yarn and polyester filling,” the description of the product reads. “It is easy to wear pinned to underclothes or tucked in a packing pouch, and can be felt by the wearer without being visible externally (shown in a pair of undies to demonstrate).”

“Silicone prosthetics do not come in sizes appropriate for smaller bodies,” the site notes, “and can create unsightly and age-inappropriate shape. The Bitty Bug® is lightweight, comfortable, low maintenance, and can be tossed in the washing machine.”

Though the “Bitty Bug® soft packer” is made for children, the company says they also make “the Lil’ Bug® and Lil’ Bug Jr.® in sizes suitable for teens and adults.”

In a “note” to their customers, Stitchbug Studio emphasizes that the Bitty Bug® soft packer is not for “infants or very young children,” though they are for “youths” and “trans youngsters”:

Left-wing activists have increasingly pushed transgenderism onto children.

Dr. Rachel Levine, tapped as President Joe Biden’s Assistant Secretary for the Department of Health and Human Services (HHS), has expressly stated support for the use of puberty blockers and the medical transition of minors. The Daily Wire reported:

Levine has spoken publicly about support for the medical transition of minors and the use of puberty blockers for children who “just start puberty” as a way to make sure they don’t “go through the wrong puberty.”

… [In 2017,] Levine spoke about past patients, including a 16-year-old boy who “always felt female.” The minor was directed to counseling, given hormones, and transitioned. Likewise, another patient of Levine’s, a 17-year-old girl who “always felt male,” went through the same medical process and transitioned to the male gender.

Pre-pubescent children do not receive medical treatment, Levine said. But as soon as a gender confused child starts puberty, they could be given puberty blockers so they “never go through the wrong puberty.”

At around ages 14-16, Levine said, minors can start cross-gender hormones.

Most surgical treatments start at age 18, added Levine, carving out some exceptions for surgical transitions at an earlier age.

4th Grader Roasts Teacher On Wearing Masks During Classes At Emergency Board Meeting (VIDEO)

One 4th grader is gaining lots of attention on social media after giving his reasons to end the mask mandate at an emergency board meeting. There are less than 12 days of the school year remaining but leaders voted 4-1 to make masks optional beginning June 1 which is after the current school year ending date.

Martin County School District in Florida, voted to keep the mask mandate for its final 12 days of school and after June 1, masks will be optional for graduation ceremonies and during summer school.

10-year-old John stood in front of Martin County board members sharing how he expected school to be different at the beginning of the year but not that things would stay the same all year long.

“I was surprised by the rules. A lot of them didn’t make any sense to me, like the fact that we were not allowed to play on the playground or have student council or turn to face each other at lunch. And we also have to wear masks outside at PE and on track,” John shared.

John shared how he loves his school but teachers yell at students for having masks down to drink water even though they are outside in the ‘car line.’

“I love my school and all, but my teachers seem really stressed and that makes me feel bad. One teacher walks around with a clipboard full of referrals for any student whose mask isn’t on properly. It makes me feel scared. That same teacher yells at us having our mask down to drink water while we are outside in the car line,” the 4th grader shared.

“She told us we had to wait until we were in her parents’ car to have a drink of water. She had her mask down the entire time while she was yelling at us, which makes me and all my friends very mad. This happens a lot.” John also shared.

4th Grader Learns The Meaning Of Hypocrisy 

“And it seems unfair teachers take their masks off while they yell at us kids and that we need to pull ours up. I asked my mom if there is a word for this and she said there is, hypocrisy,” the 4th grader called out the teacher.

“Wearing a mask all day makes me feel really tired and gives me really bad headaches. Sometimes I’m in school and I need to lay low in the dark until they’re gone. My mask also sticks to my face when it’s hot and it makes it hard to breathe. I feel like I can’t catch my breath and that makes me feel claustrophobic and anxious. It’s really stressful,” John stated.

Some parents also shared their thoughts at the meeting about making masks optional.

We have a little over two weeks left of school, I’m asking you to please let the children see the faces of their classmates and the emotions of their classmates again. Children are in the middle of a long testing period. I ask that you allow them to do it without a mask. I have a fifth-grader and an eighth-grader that would be participating in moving up ceremonies. And I am asking that you allowed to let them do that without a mask,” one parent emotionally shared.

“As the year has progressed and we’ve collected more data and a better understanding of the virus, I believe there is absolutely no reason for my child to be wearing a mask in school, certainly not a mask outdoors in the Florida heat,” said Tiffany Williams, a parent in Martin County, WPBF reported.

Poll: 42% Still Believe in Wearing Masks Outside Despite CDC Update


A significant portion of the public still believes in wearing a mask outside regardless of guidelines from the Centers for Disease Control and Prevention (CDC), according to a recent survey.

The survey indicates that forty-two percent of respondents believe everyone in their area should continue to wear a mask regardless of the CDC guidelines.

Of the respondents, 39 percent said everyone should follow the CDC guidelines that state masks are only necessary outdoors when in crowds compared to only 19 percent of respondents who actually believe “everyone should do [what] they want regardless of guidelines.”

Of those who believe in continuing to wear masks, broken down by party, the results were almost even; 36 percent of Republicans and 37 percent of Democrats want everyone around them to wear masks.

Before the poll, the CDC had updated its guidance to state that vaccinated individuals do not need to wear a mask outdoors except in crowded areas. Last week, the CDC made an additional update, saying fully vaccinated people “no longer need to wear a mask or physically distance” and only must do so when required by laws, rules, or regulations, including local businesses and workplace guidance.

The CDC defines a fully vaccinated person as someone who received a second dose in the two-dose series of the Pfizer-BioNTech or Moderna or two weeks after the single-dose Johnson & Johnson vaccine.

Since the latest update in guidelines, major business chains have revised their own guidelines. Chains such as Trader Joe’sWalmart, and Target have announced they will no longer require customers to wear masks; they did not mention a state by state policy, whereas Costco announced its policy updates will be on a state by state basis.

Last week, the fully vaccinated far-left Rep. Alexandria Ocasio-Cortez (D-NY) told her 8.8 million Instagram followers she will “probably” continue to wear a mask from “time to time” despite what the CDC says. She jokingly said masks are also “a nice accessory when you don’t want to do all your makeup.”

The Hill-HarrisX survey was conducted online among 918 registered U.S. between May 10 and May 11. It has a margin of error of +/- 3.23 percentage points. Results were weighted for age, gender, region, race/ethnicity, income, political party, education, ideology, and area type where necessary to align with their actual proportions in the population.

Report: Mexico Offers Biden a ‘Remain in Mexico II’ Border Option


Mexico’s government will open migrant camps to deal with the “humanitarian emergency” caused by President Joe Biden’s welcoming message for Central American migrants, the Los Angeles Times reported Monday.

According to the Times, “Mexico says it plans to open 17 new camps in coming weeks and months in southern states to accommodate migrant families and kids.”

It is not clear if the camps will be used to house migrants who are denied entry at the U.S. border, or if they will only be used for migrants caught at Mexico’s southern border.

Currently, Mexico cannot house and feed the migrants traveling through its territory and those quickly returned from the U.S. under pandemic health protocols known as Title 42, a measure invoked by the Trump Administration and kept in place by the Biden administration.

Last week, Politico reported that Democrats and immigration advocates accuse the Biden-Harris administration of keeping Title 42 in place to limit immigration, not protect the country against the Chinese coronavirus, highlighting another example of different views among the Democrats over how to handle the border crisis. Members from both parties have blasted the Biden administration for not providing any solutions.

On Monday, the Lost Angeles Times reported:

[W]ith most migrants … quickly returned under pandemic health protocols, Mexico is facing its own crisis — an escalating humanitarian emergency caused by what authorities and advocates call an unprecedented increase in migrant families traversing its territory.

The Mexican government has failed to develop a strategy to care for the tens of thousands of migrant women and children expelled by U.S. authorities or in transit or stuck somewhere in Mexico. Instead, Mexican authorities have mostly outsourced the task to an over-stretched patchwork of private and religious charity outfits, medical aid organizations and sundry good Samaritans.

Soon after taking office in January, Biden ended the Remain in Mexico program, which had proven remarkably effective in ending the Catch and Release policy whereby migrants are arrested and subsequently released into the U.S. interior while awaiting their asylum hearings.

President Biden vowed to allow migrants who had enrolled in the program during the Trump administration and were waiting in camps in Mexico back into the United States.

As of May, the Biden administration had released thousands of migrants who had enrolled in the Remain in Mexico program, offering them work permits to take American jobs.

The U.S. is now facing an almost two-decade high in U.S. Border Patrol apprehensions, along with a sharp increase in arrivals of families and unaccompanied minors, the majority from the Central American region known as the Northern Triangle (Guatemala, Honduras, and El Salvador).

Although the Biden Administration is not applying Title 42 to unaccompanied children and some families while claiming that the border is closed, the historic migrant surge has resulted in the U.S. denying admission to many people, mostly Central Americans, who end up in Mexico.

Echoing some Central American governments, Mexican President Andrés Manuel López Obrador’s (AMLO) administration continues to blame the Biden administration’s immigration policy for the ongoing border crisis at the U.S. southern border.

The LA Times noted:

Mexican officials say that, aside from poverty, crime and other issues in their homelands, migrants are propelled by two factors: Somewhat relaxed border controls under the Biden administration, especially for children; and the belief of some parents that crossing as a family might facilitate entry into the U.S.

Although Mexico is no longer accepting families with small children, it still takes in deported migrants under Biden, who wants the country to take even more.

On Sunday, the

New York Times indicated

that the Biden administration is not using Title 42 to deny admission to a growing wave of economic migrants from

160 countries

outside Mexico and the Northern Triangle region, including Brazil, India, Cuba, and Venezuela.

Under federal law, the U.S. can only provide asylum to groups fleeing political and religious persecution — not to people fleeing poverty. This rule means border agents can deny them access to U.S. asylum courts.

Poll: Overwhelming Majority of Voters Still Aligned with Trump Policies


Republican voters believe former President Donald Trump represents what the Republican party needs to follow on a wide range of issues, according to a recent CBS News/YouGov poll.

For example, 89 percent believe in following Trump’s example on economic issues, and 80 percent say we need to follow Trump’s form of leadership.

Looking deeper, 88 percent say Trump’s stance on immigration issues needs to be followed, including 73 percent of the respondents who said the former president set an example on race issues.

However, when it comes to the left and the media, sixty-nine percent said Trump set the example on how to treat the left, and seventy-seven agreed with the way Trump treated the media.

Additionally, a huge majority (67 percent) of Republican voters believe President Joe Biden is not the legitimate winner of the last presidential election, including 34 percent of respondents who think Republicans who are disloyal to the base should be punished.

The survey also asked about the Republicans’ strategy for winning reelection in 2022 and 2024, which would ultimately help win back the House for Republicans. Fifty-three percent said Republicans need to focus on the “message” to find more people to vote Republican. The poll added,  Republicans “should tell the public about popular policies and ideas, and will win if more people hear about them.”

The CBS News/YouGov survey was taken between May 12 and May 14, questioning 951 self-identifying Republicans who had previously taken a poll with CBS News in 2021. The sample was weighted to represent Republicans in the previous national polls, according to gender, age, race, education, geographic region, 2020 presidential vote, political ideology, and degree of partisan identification. The margin of error is +/- 3.5 percentage points.

Biden Issues Warning to Americans: ‘Those Who Are Not Vaccinated Will End Up Paying the Price’


Throughout the pandemic, the left has insisted on violating Americans’ medical freedom. Even as the danger from COVID-19 wanes, President Joe Biden is warning people who don’t want to do what he wants.

“If the unvaccinated get vaccinated, they will protect themselves and other unvaccinated people around them,” Biden said at the White House on Monday. “If they do not, states with low vaccination rates may see those rates go up, may see this progress reversed.”

There are multiple problems with this statement. First, it implies that it is the responsibility of every American to get vaccinated in order to protect others.

If people choose not to get vaccinated, that decision is made at their own risk, and it is not anyone else’s duty to protect them.

They have the right to make their own decisions, but they also face whatever consequences those may have.

In addition, the suggestion that everyone needs to get vaccinated in order to protect the vulnerable is anti-scientific at its core.

According to the American Journal of Managed Care, Democratic favorite Dr. Anthony Fauci said that “effectiveness is easily as good, if not better” for the vaccine in real-world settings than in clinical trials.

“The efficacy of the vaccine stretches across age groups and is 97.5% effective at preventing severe or critical illness and 96.7% effective at preventing COVID-19 deaths,” the journal reported Monday.

Since the majority of vulnerable people in the United States have already been vaccinated, they are now overwhelmingly protected from the threat of serious illness or death.

Should Biden have issued this warning to unvaccinated Americans?

This is true whether or not other people around them are vaccinated. If the vaccines are as effective as Fauci says, there is a very minuscule threat to vaccinated people even if they were to come into contact with someone who was unvaccinated and had the disease.

However, Biden continues to advocate forcing the vaccine on every American. He even issued a direct warning to those Americans who choose not to get vaccinated.

“Ultimately, those who are not vaccinated will end up paying the price,” he said.

Immediately after this, Biden admitted the exact reason why his logic is flawed when he said that “the vaccinated will continue to be protected against severe illnesses.”

If that statement is true, and it appears to be so, then why is Biden so concerned with telling everyone else what to do?

Anyone who wants to be vaccinated can be, and they are largely protected from the virus at that point. Biden has been vaccinated himself and is therefore at extremely low risk.

By the same token, anyone who does not want to be vaccinated should be able to choose not to receive the vaccine. This may or may not be a smart decision, but it is one that Americans are afforded under the Constitution.

Furthermore, the argument that their decision could put others in harm’s way has lost almost all merit. Democrats used the same logic when attempting to force Americans to wear masks, but the fact that a very effective vaccine now exists renders that argument even less potent.

Medical freedom has always existed in the United States. Each time flu season rolls around, Americans choose whether or not to get vaccinated, and that has never been a huge problem.

It wasn’t until COVID-19 came around that people started arguing in favor of forcing medical decisions on every American. Such action is both anti-American and anti-scientific.

There is no problem with Biden telling Americans that the vaccine is effective and easy. However, his new rhetoric of “get the vaccine or else…” is crossing the line.

Pence: Biden’s Tax Policies Would Put China First, End the Jobs Boom That Trump Tax Cuts Unleashed


Former Vice President Mike Pence argued in an opinion piece for Fox News on Monday, tax day, that if President Joe Biden’s sock-it-to-American-job-creators tax plan were put in place, it would be a boon to China.

He’s right.

“Under the Trump-Pence administration, we proved that low taxes are the key to creating prosperity for Americans of every background and income group,” Pence wrote.

The passage of the Tax Cuts and Jobs Act in December 2017 was the key.

“Within months, our economy took off like a rocket,” Pence recounted. “America gained more than 7 million new jobs, unemployment plummeted to the lowest rate in 50 years, and more than 10 million people were lifted off of welfare — the largest reduction in poverty in modern history.”

As the old adage goes: “The best anti-poverty program is a job.”

“Cutting taxes on American employers was a central part of our efforts to bring jobs and factories back home to the United States — and it worked,” Pence explained.

“After losing 60,000 factories under the previous two administrations, America gained 12,000 new factories, because employers were no longer driven away by an exorbitant tax burden.”

One of the central components of the Trump tax cuts was cutting the corporate tax rate from 35 percent — the highest in the industrialized world — to 21 percent, more toward the middle.

Prior to the cuts, the combined federal and state effective tax rate averaged 37.5 percent, which dropped to 24.6 percent in 2019, according to the nonpartisan Tax Foundation.

Under Biden’s plan, the combined rate from slightly below China’s 25 percent to well above it at 32.34 percent.

In addition to raising corporate tax rates, Biden reportedly wants to raise capital gains taxes significantly.

The Wall Street Journal editorial board reported the top capital gains tax would go from 23.8 percent to 43.4 percent.

The capital gains tax is a tax on investments, so this policy would be a disincentive to invest, which is what allows businesses to grow and to create jobs.

As with corporate taxes, states also tax capital gains, meaning several of them, including California, New York and New Jersey, would have a combined rate of over 50 percent, according to the Tax Foundation.

“Job growth will trickle to a standstill,” Pence said would happen under Biden’s approach. “Capital investments will be canceled. Fewer products will be Made in the USA. Manufacturers will pack up and head overseas, leaving a hole in the heart of blue-collar communities.”

“Worse yet, China stands to become one of the biggest beneficiaries of the Biden tax hikes,” he added.

With former President Donald Trump’s pro-growth tax and regulatory policies still in place, the economy rebounded strongly following the COVID shutdowns of last spring.

Prior to the COVID-19 shutdowns, the U.S. was experiencing some of its best economic numbers in a long time, including a 3.5 percent unemployment rate, the best since 1969.

In March, the unemployment rate fell to 6 percent from a peak of 14.8 percent in April 2020.

It ticked back up to 6.1 percent last month, with 266,000 jobs added, well short of the nearly one million that some economists anticipated as COVID restrictions continued to lift.

The disappointing number came after Democrats passed and Biden signed into law the $1.9 trillion American Rescue Plan Act in March, which increased taxes by $60 billion and extended the enhanced unemployment benefits, set to expire that month, until September.

At least both of these moves are relatively minor in size and scope.

If Biden and the Democrats manage to push through drastically increasing taxes on corporations and investments, it would be disastrous.

“After four years of America First tax and trade policy, our foreign competitors would gladly welcome the self-imposed competitive disadvantage,” Pence concluded.

“China stands to gain thousands of jobs as employers flee the crushing tax and regulatory burden of Joe Biden’s America.”

The Handout That Rocks the Cradle: 88% of Kids Covered by Monthly Payments Starting in July


The Treasury Department said Monday that it will start sending out payments to nearly all families with children in the U.S. beginning on July 15, launching one of the biggest cash distribution schemes ever undertaken by the federal government.

The payment will cover 39 million families, according to the Treasury Department. Nearly 88 percent of children will be covered benefits their parents will automatically receive without the parents needing to take any additional action.

The payments are part of President Joe Biden’s $1.9 trillion coronavirus relief package, which expanded the child tax credit for one year and made it possible to pre-pay the benefits on a monthly basis.

“This tax cut sends a clear and powerful message to American workers, working families with children: Help is here,” Biden said in remarks at the White House.

Qualified families will receive a payment of up to $300 per month for each child under 6 and up to $250 per month for children between the ages of 6 and 17. The child tax credit was previously capped at $2,000 and only paid out to families with income tax obligations after they filed with the IRS.

But for this year, couples earning $150,000 or less can receive the full payments on the 15th of each month, in most cases by direct deposit. The benefits total $3,600 annually for children under 6 and $3,000 for those who are older. The IRS will determine eligibility based on the 2019 and 2020 tax years, but people will also be able to update their status through an online portal. The administration is also setting up another online portal for non-filers who might be eligible for the child tax credit.

The president has proposed an extension of the increased child tax credit through 2025 as part of his $1.8 trillion families plan. Outside analysts estimate that the payments could essentially halve child poverty. The expanded credits could cost roughly $100 billion a year.

Some have proposed that the Biden program be extended permanently, essentially creating a new federal entitlement program that would make American families far more dependent on government payments than any time in U.S. history.
