Labor Department Plans Drug Test Regulation for Unemployment Benefits

The Donald Trump administration hopes to unveil a new Labor Department regulation in June requiring drug testing for unemployment benefits.

Republicans used the Congressional Review Act (CRA) to repeal an Obama-era regulation that limited states’ ability to limit drug testing for people who apply for unemployment benefits.

After President Trump signed the CRA repealing the Obama-era regulation, House Ways and Means chairman Kevin Brady (R-TX) said:

President Trump just signed into law my bill that abolishes an Obama-era rule. After five years of battling with the Obama Department of Labor, states like Texas will now be allowed to drug test folks on unemployment to ensure they are job-ready from day one. This is a win for families, workers, job creators, and local economies.

Chairman Brady proposed the bill with Sen. Ted Cruz (R-TX), who sponsored the Senate version of the CRA.

American unemployment claims remain at a 17-year record low, and American consumer sentiment reached its highest level since 2000, according to the University of Michigan.

Republicans argued that the 2016 unemployment rule only allowed unemployed Americans to submit to drug testing if they were in occupations that typically required testing, which includes airline pilots, flight crews, air traffic controllers, commercial and public transit drivers, as well as any job that requires Americans to regularly carry a firearm.

The Labor Department signaled that it planned to issue a more expansive rule redefining which jobs will have to submit to regular drug testing for unemployment claims.

In the Trump administration’s roadmap for new regulations, the Labor Department stated that “states no longer have authority to drug test unemployment compensation applicants for whom suitable work is only available in occupations that regularly conduct drug testing for unlawful use of controlled substances.”

The Labor Department said that it will issue a notice of proposed rulemaking that “will identify the occupations that regularly conduct drug testing.”

Strategic Services on Unemployment and Workers’ Compensation President Doug Holmes said if they wish to be paid through state unemployment benefits, they need to make themselves able and available to work, and that includes passing a drug test.

Holmes suggested, “This is an insurance program, it’s not public assistance.”

Holmes then continued, arguing that the previous Labor Department rule was too restrictive.

He explained:

An individual has to be available and able to work. If they’re not available and able to work, week by week by week, then they don’t meet the requirements to be paid unemployment compensation benefits. If an individual has a significant problem that renders him or her unavailable to work, the appropriate response is to refer them to a place to get help. They should not be paid unemployment benefits.

The regulatory agenda said that the Labor Department plans to release its proposed rule in June.

Labor Department spokesman Eric Holland revealed that the agency is “diligently working on a new proposal regarding unemployment compensation drug testing that will be substantially different from the prior rule.”

“When it is ready, we will publish it in the Federal Register for review and comment by the public,” Holland added.

Uncovering vote fraud: Plan B begins

Before progressives start celebrating the dissolution of the Election Integrity Commission, they had better figure out what lies ahead.  President Trump announced late yesterday that the Election Integrity Commission, headed by Kansas secretary of state Kris Kobach, will be dissolved.


“Rather than engage in endless legal battles at taxpayer expense, today President Donald J. Trump signed an executive order to dissolve the Commission, and he has asked the Department of Homeland Security to review its initial findings and determine next courses of action,” White House press secretary Sarah Sanders said in a statement.


The commission, led by Vice President Mike Pence and Kansas [s]ecretary of [s]tate Kris Kobach, had asked all 50 states and the District of Columbia to hand over reams of personal voter data, including voters’ names, voting histories[,] and party affiliations.



If the left thinks it’s home free, and that this announcement is a victory, it had better remember whom it is dealing with: a man who is accustomed to encountering obstacles and overcoming them – one way or another.  Kris Kobach and Donald Trump are in sync.


Kobach characterized the decision to dissolve the bipartisan group as a “tactical change” and argued DHS can pursue an investigation of election fraud more quickly and efficiently.


Kobach expanded on this with Breitbart:


“What’s happening is a tactical shift where the mission of the commission is being handed off to Homeland Security without the stonewalling by Democrats,” Kobach told Breitbart News.


“I’ll be working closely with the White House and DHS to ensure [that] the investigations continue,” Kobach continued.


I think the left has outsmarted itself by making alleged “Russian hacking” of the election a national security issue.  This opens the door for DHS – armed with far more investigatory power than any commission might exercise – to go full bore at election fraud.  President Trump tried it the nice way, only to encounter obstruction.  Now it is time for Plan B, and I am pretty sure that Democrats will not like it at all.


And it is not as though there are no problems:   


Kobach, who served as vice chairman of the voter fraud commission, blasted organizations like the ACLU and NAACP, along with Democrats in Congress and on the commission who attempted to halt the panel in its tracks.


“They have absolutely no interest in stopping voter fraud,” Kobach said.  “It’s truly extraordinary that one party in our system has made clear that they don’t care.”


“Some people on the [l]eft were getting uncomfortable about how much we were finding out,” Kobach continued.


Thus far, the voter fraud commission has revealed:


  • 938 convictions for voter fraud since the year 2000
  • Fewer than 1 in 100 cases ends in a conviction
  • In Kansas, alone, there are 127 known cases of non-citizen aliens registering to vote
  • In 21 states, there were 8,471 cases of double[-]voting discovered


The commission will now more soundly operate without hold-ups in courts, lawsuits, and political battles, a move that Kobach says Democrats brought onto themselves.


“The investigations will continue now, but they won’t be able to stall [it] through litigation,” Kobach told Breitbart News.


Those running the progressive left understand the stakes in vote fraud: their power.  That is why this move toward energetic investigation under the mantle of national security may be far more fateful than it appears on the surface.  Before trying to obstruct President Trump, be careful what you wish for.

New England wanted to use all renewable energy… then it got cold

During a recent trip to Maine, my wife and I noticed the large number of wind turbines cluttering the peaks of the ridges around the otherwise scenic New England countryside, particularly in Vermont. There really are a lot of them, and that’s the result of an ongoing push to get the region onto renewable energy as much as possible. Vermont in particular has been hammering wind power as the path to cut carbon emissions and make the state truly green in nature. And they’ve achieved an admirable level of success, despite the fact that people living near the wind farms are being driven batty by all the noise and the state is being forced to enact additional restrictions on turbine operation.

But for the most part, as I said, that was all well and good… at least as long as the weather was pleasant. Now, however, as I’m sure any of you living in the northeast are aware, there’s a blistering bubble of arctic air throwing the region into a deep freeze. Suddenly the power grid is experiencing strains which aren’t generally seen in more clement weather conditions. So how are they responding? Local Hartford, Vermont blogger Meredith Angwin has been keeping an eye on the grid and she’s seeing an alarming trend (or at least alarming to environmentalists). As the temperature dropped, wind energy production waned just as demand was rising. And the local power companies responded by… burning oil.

During cold snaps, gas pipelines must supply homes first, and gas-fired power plants get short-changed. ISO-NE has a Winter Reliability Program which mainly compensates gas-fired power plants for keeping fuel on site: oil or LNG or CNG. (Liquefied or compressed natural gas.) The grid was running about 22% oil at 5:30 this evening.

The current Winter Reliability program is described in an update presentation, given December 7, 2017 by Anne George of ISO-NE. On page 5, Ms. George describes the current winter reliability program, which pays oil and gas fired generators to have fuel on site. (Page numbers are at the lower right of each viewgraph.) On page 18, she describes how the forward capacity auctions are attracting new generation, even as older plants retire. Specifically, ISO-NE is attracting new dual-fired natural gas resources: gas turbines that can also burn oil, and therefore can store oil on-site for cold weather.

In a follow-up post, Angwin records what happens to the grid as the temperature falls further. By the time it was down to one degree (!) the average cost of electricity on the grid had spiked from $200 per megawatt hour (Mwh) to over $300 / Mwh, with some areas reaching as high as $338. In addition to that, the percentage of energy on the grid coming from burning oil in dual-purpose plants (which can also use natural gas when it’s available) had jumped up to account for nearly one third of the total load.

As you can see, oil and nuclear account for nearly 60% of the power being consumed, while renewables are only managing to produce 7% during peak demand hours. And of that 7% renewable energy, the wind farms were only kicking in 13% of it. Fully 85% of the renewable energy was coming from burning wood or refuse. So what does all this mean? I’m not saying we shouldn’t be using wind, solar and most anything else we can get our hands on when it’s practical to do so. But as we’ve been preaching here for years, what’s really required is an all of the above energy strategy which doesn’t fall victim to politics. That’s something that Rick Perry has been trying to get across since taking over as Secretary of Energy. Abandoning traditional energy sources in favor of politically popular but limited renewable options is foolish. Conditions change. Sometimes it’s cloudy. Sometimes the wind doesn’t blow. And sometimes it gets really, really cold. That’s why he’s been trying to ensure that we retain our ability to produce power using coal, oil and nuclear as needed. But this has resulted in withering criticism, primarily from Democrats. (Washington Examiner)

Most lawmakers asking questions at a House Energy and Commerce subcommittee hearing seemed skeptical of Energy Secretary Rick Perry’s plan, expressing concern that it would undermine an “all of the above” energy landscape by favoring certain power sources over others.

“This is quite a misguided effort they need to put back to the shop,” said Rep. Kathy Castor, D-Fla. “Clearly [the Trump administration] are favoring fuel sources that are less competitive today. This will cost consumers dearly.”

Rather than carping about Perry’s energy plans, perhaps these critics should take a trip up to Vermont this weekend when the temperature is expected to hit negative 10 without the wind chill. Take a look at their power grid and then tell us how we need to all be converting to wind and solar. You’re putting people at serious risk if we cripple the power grid and we need to come to grips with that reality.

NHS Orders Britain to Cancel 50,000 Surgeries as ‘Third World Conditions’ Devastate Hospitals

Yup, let’s have government-run healthcare!

The British government-run National Health Service on Tuesday ordered every hospital in England to cancel all non-urgent surgeries in order to free up staff and beds for emergency patients.

The NHS order will result in around 50,000 operations being postponed until at least February as overcrowded hospitals struggle to tend to everyone, the Telegraph reported. A spike in winter flu has forced frail patients to face 12-hour waits while some hospital corridors are running out of space.

British Prime Minister Theresa May apologized on Thursday to the patients whose operations were canceled, calling the situation “frustrating.”

“I know it’s difficult, I know it’s frustrating, I know it’s disappointing for people and I apologize,” May told Sky News during a visit to a hospital outside London.

Woman Asks for Female Nurse During Sensitive Exam, Gets Social Justice Instead

Can a society “progress” too far? For one UK woman, the answer is a resounding, “Yes.” She learned the hard way that when a society champions itself as “progressive,” there are serious consequences. And those consequences can backfire at any given moment.

One woman went in for a very private and personal cervical smear test and specifically asked for a female NHS nurse to administer the exam. What she got, however, was something else entirely.

According to the Times, the woman said she was “embarrassed and distressed” when a man with “a deep voice summoned her for the intimate procedure.”

She explained that the nurse “had an obviously male appearance … close-cropped hair, a … large number of tattoos and facial stubble.”

The patient then voiced her concern and expressed there must have been some mistake. The nurse, however, let her know there was no mistake. “My gender is not male,” he said. “I’m a transsexual.”

Of course, the woman decided not to proceed with the exam.

The woman told the Times it was “weird where somebody says to you: ‘My gender is not male’ and you think: ‘Well, what does that even mean? You are clearly a man.’”

The patient then sent an official letter to complain about the situation. She wrote, “People who are not comfortable about this are presented as bigots and this is … kind of how I was made to feel about it.”

The NHS sent a formal apology to the woman. “We apologized to this patient for the recording error and because the staff member accepted they didn’t manage the situation appropriately; the patient needed to feel listened to. Trust policy is to consider seriously all requests for clinicians of a particular gender.”

This incident, however, raises broader concerns as the UK’s governing Conservative Party is considering proposals which would allow people to legally change their gender without a doctor’s diagnosis.

Opponents of the legislation argue that allowing people to change their gender whenever they so desire would make instances like the one mentioned above more common.

“Politicians have not thought through all the implications of allowing self-certification,” said James Caspian, a psychotherapist who specializes in working with transgender people. He also explained that these situations would occur more often if “self-certification went ahead.”

He’s absolutely right.

Issues are bound to arise when you allow people to dictate their gender on a whim. This case is a prime example of such consequences.

Sadly, though, these types of complaints may soon be commonplace. And those who do not accommodate requests like the one mentioned in this article? Accusations of “hate crimes” or at the very least “hate speech” will likely become commonplace as well.

So, can a “progressive” society progress too far? Absolutely. And unfortunately it doesn’t seem as if anyone is stepping on the breaks.

Clint Eastwood Shows Hollywood How It’s Done With Brand-New Movie Honoring True American Heroes

Movie producer and tough-guy Clint Eastwood has one-upped Hollywood by casting real-life members of the military in his latest film “The 15:17 to Paris,” which tells the story of how three American heroes helped prevent a terrorist attack on a train from Belgium to France in 2015.

In what Variety magazine called an unprecedented move, Eastwood cast the three Americans as themselves.

Anthony Sadler, 23, National Guard Spc. Alek Skarlatos, 22, and Air Force Airman Spencer Stone, 23, will star in the movie that shows how they intervened when Islamic militant Ayoub el-Khazzani opened fire on a train filled with 554 passengers.

Eastwood’s movie is based on the book “The 15:17 to Paris: The True Story of a Terrorist, a Train, and Three American Heroes,” written by the men with the help of Jeffrey E. Stern.

The film follows the course of the men’s lives and highlights the events that shaped them, ultimately preparing them for the moment when they faced the terrorist.

The BBC reported that El-Khazzani was heavily armed when he boarded the train. A French passenger encountered El-Khazzani on the way to the restroom. A scuffle ensued and the gun went off. A French-American passenger was reportedly injured by the shot.

Within moments, Sadler, Skarlatos and Stone were among the passengers who stepped in and stopped El-Khazzani.

In an interview with CBS, Skarlatos said his reaction was a “gut instinct.”

Stone told CBS that the gunman seemed “ready to fight to the end,” adding that he and his friends were also ready to do what needed to be done to stop the terrorist.

The men were awarded the Legion of Honor — France’s highest award — for their bravery.

The movie will no doubt highlight how ordinary men can overcome adversity and accomplish extraordinary things.

In an interview with Entertainment Weekly, Eastwood said the movie was a tribute to the common man.

When asked about casting the heroes as themselves, Eastwood said that he looked at others who could do the job, but he was struck by how the faces of the heroes were unique. He added that it would be “an interesting experiment.”

If “The 15:17 to Paris” has the same reception as other Eastwood projects like “Sully” and “American Sniper,” which also focused on real-life heroes, it will be a box-office hit.

Report Claims The Earth Will Become A Desert Without Paris Climate Deal

A large portion of Earth will be covered in desert wastelands if the world does not meet the goals of the Paris climate deal, according to a research group with a history of making dubious claims.

More than 25 percent of the world’s population will be living in a drought and growing desertification if global temperatures increase 2 degrees Celsius by 2050, reads a report published Monday in the journal Nature Climate Change.

“Our research predicts that aridification would emerge over about 20-30 percent of the world’s land surface by the time the global mean temperature change reaches 2ºC,” Manoj Joshi, a lead researcher from University of East Anglia in the United Kingdom, said in a statement announcing the findings.

Recent research has repudiated similar claims. A report published by the Massachusetts Institute of Technology (MIT) in 2016, for instance, suggests that more carbon dioxide, not less, increases plant growth, limiting the impact temperatures have on climate change.

Previous studies estimate global warming has caused roughly half of Earth’s landmass to demonstrate “significant greening,” and that only 4 percent of the world saw a decrease in plant life. The increased vegetation presumably permitted by warmer temperatures is slowing global warming as well since more trees and plants sequester CO2.

Other claims from scientists at the University of East Anglia have not come to fruition. One researcher predicted in 2000 that kids would grow up without snow; however, it’s been nearly 18 years since U.K. climate scientists at the university argued that global warming would make snowfall a “a very rare and exciting event.”

“Children just aren’t going to know what snow is,” Dr. David Viner, a scientist with the climatic research unit at the University of East Anglia, told the UK Independent in 2000. UK Independent eventually took down the post after the comment gained notoriety within conservative media.

‘Take that Godd**n flag down’: Woman allegedly gets violent with elderly neighbor over Old Glory

Steve Horner simply wanted to fly his American flag in his front yard like others on his block in Lecanto, Florida, have done, WTVT-TV reported.

But the 69-year-old’s decision to hoist Old Glory last weekend apparently didn’t sit well with one of his neighbors.

Horner told WTVT that 50-year-old Lucille Blanchard “texted my wife, ‘What’s up with the flag?’” Then it got uglier.

“We’re just minding our own business,” Horner told the station, adding that Blanchard said “take that Godd**n flag down just for one day.”

But Horner was having none of it.

“I said, ‘I ain’t taking that flag down,’” he told the station, adding that “it’s an American flag, and I always flew one.”

What happened on Christmas Eve?

And apparently the issue came to a head — of all days — on Christmas Eve.

Horner told WTVT that Blanchard took the flag stand out and threw it at the ground. “I told her, ‘You come over here again, I’m going to call the law on you,’” Horner recalled to the station.

Then Horner told WTVT that Blanchard got violent.

“I was holding on to it, and she was pulling my shirt, and I just turned loose of the flag and just let her take it,” he told the station.

What happened to Blanchard?

Citrus County Sheriff’s deputies were called and arrested Blanchard, WTVT said.

Blanchard also was accused of pushing the victim backward and stealing his American flag, the Citrus County Chronicle reported, citing her arrest affidavit.

She was charged with felony battery on a person over the age of 65 and misdemeanor petit theft, the paper reported, adding that Blanchard’s bond was set at $2,500.

Why did Blanchard want the flag down?

Horner told WTVT she wanted the U.S. flag taken down because her son and grandfather “both died.” It isn’t clear in what context her son and grandfather died, but Horner told the station he replied by saying “the flag ain’t got nothing to do with it.”

And as you might expect, Horner declared his flag isn’t coming down anytime soon.

“No, I’m not going to take it down,” he told WTVT. “Why in the hell should I take down?”

Reacting to the bizarre and cringe-inducing image of a CNN reporter wearing a gas mask as she held an orange bong, Brent Bozell on Tuesday quipped, “CNN is trying to trademark the debauchery as its brand for New Year’s Eve coverage. I mean that quite seriously.” The MRC president appeared on Fox Business and reminded everyone of CNN’s embarrassing history of New Years coverage.

Media Research Center President Brent Bozell joins us now. Brent, I thought the tide against Trump was turning maybe a little bit but apparently not?

BOZELL: We were looking at this during the campaign. It was 91 percent negative during the campaign. Then during the honeymoon period where things get nice, it was only 89 percent negative. Which goes a long way, by the way, in explaining why so many of the American people believe they weren’t getting a tax cut. 

WEBSTER: Well that’s true, but in some perverse way, does this all play into, into President Trump’s hand? That he is against the establishment, that he is against the swamp, that he is against the media, and that, and so by tweeting over the head of the media, he appeals to his base directly. And the fact they’re always negative is not really have any impact on his base? 

BOZELL: The, look —  you’re right. The enemy of my enemy is my friend. 

WEBSTER: Yeah. 

BOZELL: The public can’t stand the news media. 

WEBSTER: Yeah. 

BOZELL: When he goes after the news media, they love it. So absolutely. Absolutely. His base is on fire because of his attacks on the news media. It’s going to continue and it’s actually going to be torqued up even worse toward the end of the race. But you are going to see one thing very interesting. When the President pushes an infrastructure bill, which is at its core, liberal, what are the media going to do? 

WEBSTER: Very good point. Another one for you, Brent, during New Year’s Eve celebrations, CNN reveled in pot smoking in a report from Denver where marijuana is legal. That picture says it all. It’s a gas mask full of pot smoke I guess. Is this CNN we now know and you know, people love and hate today? 

BOZELL: CNN is trying to trademark the debauchery as its brand for New Year’s Eve coverage. I mean that quite seriously. Go back to Kathy Griffin in 2008, using obscenities live on television. CNN said they weren’t going to use her and bring her back. Of course they did. They started dropping f-bombs. If you recall, last year she was performing simulated oral sex on the anchor during her New Year’s broadcast. So this year they’re doing pot and getting stoned. 

WEBSTER: They’re negative and they’re stoned which is unusual. All right. Brent Bozell, great stuff as always.

NYTimes: Trump Deregulation Plan Responsible for ‘Newfound Confidence’ in Business

At least one liberal media outlet has grasped the link between President Donald Trump and economic growth in 2017. According to a shockingly positive Jan. 1 New York Times report, Trump’s ongoing commitment to deregulation was responsible for 2017’s “wave of optimism.”

“While business leaders are eager for the tax cuts that take effect this year, the newfound confidence was initially inspired by the Trump administration’s regulatory pullback, not so much because deregulation is saving companies money but because the administration has instilled a faith in business executives that new regulations are not coming,” NY Times reporters Binyamin Appelbaum and Jim Tankersley stated.

The Trump administration rolled back 22 regulations for every new regulation in 2017, the president announced in a news conference Dec. 14.

Deregulation will “allow companies to engage in activities they might not have been able to otherwise,” like upgrading power plants. Comcast also announced plans for more than $50 billion in infrastructure investments, thanks to the Net Neutrality repeal.

Capital spending also rose “significantly, climbing at an annualized rate of 6.2 percent during the first three quarters of last year.”

In addition to deregulation, The Times credited “low unemployment” for also “prompting increased spending, just as it did in the 1990s.”

The Times report is a rare break from the media’s trend to ignore positive economic news during Trump’s administration.

For example, the network evening news shows ignored a whopping 80 percent of the first 31 stock market records of 2017. The evening news shows likewise only spent 52 seconds on GDP growth between January and late November 2017, despite third quarter 3.2 percent third-quarter growth.

Similarly, when the unemployment rate hit 4.1 percent in November, ABC World News Tonight ignored it. The networks likewise ignored Goldman Sachs’ Nov. 17 prediction that unemployment would fall to 3.5 percent by the end of 2019.
The Times was also silent on both the initial Goldman Sachs prediction as well as the revised one on Dec. 21 saying unemployment would actually fall to 3.3 percent by late 2019 — the lowest rate since 1952.
