The House of Representatives voted 320–88 on Wednesday evening to extend a federal ban on fentanyl and its analogs, despite the dissenting votes and voices of 86 Democrats.
The bill, S.3201, passed the Senate unanimously, but languished in the House for almost two weeks, running dangerously close to a Feb. 6 deadline after which the Drug Enforcement Administration’s blanket scheduling of fentanyl and its analogs was set to expire. Such a lapse would have made it substantially harder for federal law enforcement to prosecute dealers of the drugs responsible for tens of thousands of deaths over the past several years.
Even as they debated the bill Wednesday morning, however, some House Democrats still voiced concerns over a bill they saw as too tough on crime. Such arguments, alongside the dissenting vote from within the Democratic caucus, raise serious questions about Democrats’ commitment to using all tools available to fight the deadliest drug crisis in American history.
There are a number of different chemical variations—called "analogs"—of the synthetic opioid fentanyl. In 2018, faced with a wave of new analogs, many of which were not technically illegal under the Controlled Substances Act, the DEA used its administrative authority to temporarily place them all in schedule one, the strictest control category in the CSA.
That scheduling lasts only two years, which is where S.3201 comes in. The bill—which, according to a Senate GOP aide, was "watered down" from a full ban—extends the scheduling by a year and instructs the Department of Justice to issue a report on the effects of continuing it further. This version passed the Senate unanimously, and garnered the support of law enforcement officers across the political spectrum, including all 50 state attorneys general.
The bill’s extended stay in the House is due to Democratic opposition even to the weakened version. House Democrats managed to kill a similar provision in last December’s spending bill. On Wednesday it became apparent why House Democrats have been largely mum on the issue, as several caucus members indicated that they believed that enabling law enforcement to prosecute drug traffickers was a dangerous and wrong-headed approach.
"Let’s not enact another law that sends more people to prison while ignoring the root causes of the present crisis, which is substance abuse and which should be dealt with as a public health problem," Rep. Bobby Scott (D., Va.) said. "That’s the approach we should take, and we can take that approach by rejecting this bill."
Others, like Rep. Jan Schakowsky (D., Ill.), cited fears of the increased use of mandatory minimums in fentanyl trafficking, which she said "even the lowest quantity can trigger."
"The emergency scheduling of fentanyl and its analogs, or any other substance as a schedule one drug, has serious criminal justice implications. We should not forget our history, and what happened to communities of color during the failed war on drugs," Schakowsky said.
According to the U.S. Sentencing Commission, 433 people faced fentanyl trafficking charges in 2018, when the DEA’s temporary scheduling was put into effect. The average sentence length was roughly six years, with almost half of offenders receiving less than five years. While half were convicted of an offense carrying a mandatory minimum, half of those were "relieved of that penalty." In fact, thanks to such relief, the average fentanyl sentence was shorter than what sentencing guidelines suggest it should be.
While fentanyl traffickers contribute a small share of the federal prison population and enjoy comparatively lenient sentences, the scheduling of fentanyl has been a vital tool for law enforcement. Bob Bushman, president of the National Narcotics Officers’ Associations’ Coalition, which represents more than 55,000 law enforcement officers nationwide, told the Washington Free Beacon that "if there is no way to control or slow up the distribution and the use of these drugs, we’re going to continue to see the deaths and the addiction problems we’re seeing."
"A few years ago, we weren’t dealing with this problem on this magnitude," Bushman said. "Being able to schedule [fentanyl], being able to prosecute people that are trafficking these substances, is important. But we need help from our elected officials to put the proper laws in place to allow us to have some effective strategies to deal with this problem. We can’t just make up laws."
Rep. Greg Walden (R., Ore.), who helped lead the Republican effort to pass the bill, on Wednesday criticized his Democratic colleagues for acting slowly.
"There is no question that fentanyl poses an absolutely deadly threat to American lives, yet it took Democrats until the 11th hour to extend the fentanyl analogues ban," Walden said. "Thanks to pressure from patients, families, law enforcement, and communities everywhere, House Democrats finally joined the Senate and House Republicans in passing the fentanyl analogues ban. We can only hope that the next time lives hang in the balance, we won’t have to wait until the last minute for Democrats to act."
Twitter, which earlier decided to not accept political advertising for this election cycle, is now enacting a new policy allowing users to report accounts for allegedly posting misleading voter information or voter suppression.

The example posted by Twitter has three options to report, false information about voter registration and voting, misrepresenting a government or political entity–all good–but the third option is subjective and open to abuse: “It intends to suppress or intimidate someone from voting”.
Politico quoted a Twitter official on the new reporting policy:
“As caucuses and primaries for the presidential election get underway, we’re building on our efforts to protect the public conversation,” said Carlos Monje Jr., Twitter’s director of public policy and philanthropy, in a statement.
…It’s the first time the tool is being used in the U.S.
“This reporting flow has been an important aspect of our efforts since early 2019 to protect the health of the conversation for elections around the globe, specifically in India, the U.K., and across the EU,” Monje said.

A convicted sex offender is being let out of prison in Iowa because they identify as a woman and the Iowa Attorney General’s Office says that the transgender criminal is no longer a threat because they have different hormones.
The Storm Lake Times reported that Joseph Matthew Smith, a 23-year-old convicted of molesting a fellow MCS student in 2014, also molested up to 15 kids, according to a report prepared by the state.
“A preliminary report prepared by the state’s expert, Dr. Jeffrey Davis, says Smith molested as many as 15 victims, ranging from ages 1 to 13, before being sentenced to prison in December 2015,” The Storm Lake Times reported. “The report found the likelihood of re-offending within five years of release exceeded 20% because victims were of both genders, and because Smith was under age 25 and never had a long-term relationship.”
“Mr. Smith has not had an intimate relationship,” the government report stated. “His sexual encounters appear to have primarily involved molestation, including his own molestation by multiple perpetrators, or his victimization of others.”
“The Iowa Sex Offender Registry shows Smith was convicted of 2nd degree sexual abuse against a female victim in 2012, and lascivious acts with a child against a male victim in 2014,” The Blaze reported. “The registry does not give the victim’s ages; they are listed as children under the age of 13.”
Smith received transgender treatment for the last two years at Newton Correctional Facility and started using female pronouns.
“We don’t believe we have evidence sufficient to prove Josie Smith has a significant chance of reoffending,” Iowa AG spokesman Lynn Hicks said. “Josie Smith will be subject to strict sex-offender reporting required of those who commit the crimes [they] did. [They’ll] be subject to supervision for the rest of [their] life.”
“The report recommended Smith be confined at the Cherokee Civil Commitment Unit for Sex Offenders (CCUSO) in Cherokee for an indefinite period,” The Storm Lake Times added. “But it was premised upon Smith having the sex drive of a man.”
Federal law enforcement officials with the U.S. Border Patrol exposed the longest illicit cross-border tunnel ever discovered along the Southwest border on Wednesday in San Diego, California.
“The tunnel originates in Tijuana, Baja California, Mexico in an industrial area approximately one-half-mile west of the Otay Mesa Port of Entry,” CBP said in a statement. “Following the discovery in late August 2019, Mexican law enforcement identified the tunnel entrance and members of the San Diego Tunnel Task Force (SDTTF) began mapping the tunnel from Mexico.”
“Concealed by a small industrial building, the tunnel travels north into the U.S. bending slightly west and extending an astonishing 4,068 ft. from the border, with a total length of 4,309 ft.; over three-quarters of a mile,” CBP added. “The next longest tunnel in the U.S., discovered in San Diego in 2014, was 2,966 feet long.”
CBP said that the discovery of the illicit tunnel was the outcome of a “a challenging multi-year, inter-agency investigation, utilizing technology capabilities, intelligence gathering, and community outreach.”
Deputy Chief Patrol Agent Aaron M. Heitke said, “I am thrilled that this high level narco-tunnel has been discovered and will be rendered unusable for cross-border smuggling. I am proud of the tremendous efforts of the Tunnel Task Force and our agents.”
Cardell T. Morant, Acting Special Agent in Charge of Homeland Security Investigations (HSI) San Diego, said, “While subterranean tunnels are not a new occurrence along the California-Mexico border, the sophistication and length of this particular tunnel demonstrates the time-consuming efforts transnational criminal organizations will undertake to facilitate cross-border smuggling. This discovery underscores the importance of the partnerships HSI has with the U.S. Attorney’s Office (USAO), United States Border Patrol (USBP), Drug Enforcement Administration (DEA) and other regional agencies, as collaborative investigations and community outreach are key to combating this type of threat.”
“The tunnel, that is approximately five and a half feet tall and two feet wide, has an average depth of 70 ft. from the surface,” the statement continued. “It includes an extensive rail/cart system, forced air ventilation, high voltage electrical cables and panels, an elevator at the tunnel entrance, and a complex drainage system.”
“An offshoot from the main tunnel was discovered at approximately 3,529 ft. into the U.S. This offshoot traveled several feet then came to an end without breaching the surface,” the statement added. “The main tunnel extended another city block at which point agents discovered several hundred sand bags blocking the suspected former exit of the tunnel in the Otay Mesa warehouse district within the U.S.”

DEA Special Agent in Charge John W. Callery said, “As efforts to strengthen security on our Southern Border increase, Mexican drug cartels are forced underground to smuggle their deadly drugs into the United States. The sophistication of this tunnel demonstrates the determination and monetary resources of the cartels. And although the cartels will continue to use their resources to try and breach our border, the DEA and our partners on the Tunnel Task Force will continue to use our resources to ensure they fail, that our border is secure, and that tunnels like this are shut down to stem the flow of deadly drugs entering the United States.”
New York’s newly implemented jailbreak policy has freed six accused drug dealers who allegedly operated a $7 million heroin-fentanyl packaging ring out of a Bronx, New York City, apartment.
Livo Valdez, Jaslin Baldera, Frederick Baldera, Frandi Ledema, Diego Tejada, and Parfraimy Antonio were arrested by New York City law enforcement officials on Tuesday and each charged with first-degree and third-degree criminal possession of a controlled substance as well as second-degree criminal use of drug paraphernalia after agents seized about 750,000 glassine envelopes of suspected heroin and fentanyl from their Kingsbridge, Bronx, apartment.
Law enforcement officials said in a news release that over the course of one week, eight individuals came in and out of the apartment where the six accused drug dealers were operating the heroin and fentanyl packaging mill.
The Drug Enforcement Agency (DEA) estimates the six accused drug dealers have roughly $7 million worth of heroin and fentanyl in the apartment. Officials said the narcotics were destined for New York City and Massachusetts buyers.

Just a day after being arrested, the six accused drug dealers were released without bail as part of New York’s “bail reform” law that allows suspected criminals deemed “non-violent” to be freed from jail without ever having to post bail.
Now, the six accused drug dealers are expected to show up for their court date on February 27, and if they do, New York City Mayor Bill de Blasio’s office will provide them with gifts such as Mets tickets, movie passes, and gift cards to go shopping.
The list of crimes an individual can commit in New York without having to spend any time in jail before trial includes:
Second-degree manslaughter
Aggravated vehicular assault
Third-degree assault
Promoting an obscene sexual performance by a child
Possessing an obscene sexual performance by a child
Promoting a sexual performance by a child
Failure to register as a sex offender
Making terroristic threats
Criminally negligent homicide
Aggravated vehicular homicide
Also, as part of the New York law, the six accused drug dealers will have the ability to investigate the crime scene for themselves with their defense attorneys before going to trial. This means the six suspects can return to the Bronx apartment and collect their own evidence in their defense.
Additionally, the New York law mandates that the prosecution hand over all the names of the witnesses set to testify against the six suspects within the next two weeks — a provision of the law the opponents have said will lead to witness intimidation.
The case is the latest in which New York’s law has intervened to quickly set loose the accused. Last month, an illegal alien was freed on Christmas day after he allegedly killed a woman on Christmas Eve. The illegal alien was only charged with fleeing the scene of a deadly accident, allowing him to be eligible for immediate release without bail.

After getting caught lying to the Courts about its actions related to Seth Rich, Christopher Wray’s FBI lies again and claims it did nothing wrong.
Attorney Ty Clevenger reported to the courts on Monday that despite numerous assurances from the FBI that they had no information related to Seth Rich, the FBI had been caught and therefore was lying to him all this time. (See timeline below).
In response, the DOJ immediately stepped in with a letter to the judge. In this letter the DOJ claimed the FBI had met its burden and its search would have located emails “of investigative significance”:
The DOJ next says that after the Mueller sham, Hillary’s email exoneration, the Ukraine Hoax, Fast and Furious, FISA Warrant abuse and much more, the FBI is “entitled to a presumption of good faith”:
The DOJ says that the FBI was not investigating Seth Rich’s death and it has said so and there is no related case:

The FBI and DOJ currently cannot be trusted. Sorry, but this is because of their recent record. The courts simply cannot accept the FBI and DOJ on its word.
Texas businessman Ed Butowsky filed a lawsuit where he outed reporter Ellen Ratner as his source for information on Seth Rich. The DNC operative [Rich] was murdered in the summer of 2016 in Washington DC. His murder was never solved. According to Butowsky’s lawsuit, Seth Rich provided WikiLeaks the DNC emails before the 2016 election, not Russia.
This totally destroys the FBI and Mueller’s claims that Russians hacked the DNC to obtain these emails.
Butowsky claims in his lawsuit:
Ms. Rattner said Mr. Assange told her that Seth Rich and his brother, Aaron, were responsible for releasing the DNC emails to Wikileaks. Ms. Rattner said Mr. Assange wanted the information relayed to Seth’s parents, as it might explain the motive for Seth’s murder.
On November 9, 2016 Ellen Ratner admitted publicly that she met with Julian Assange for three hours the Saturday before the 2016 election. According to Ratner, Julian Assange told her the leaks were not from the Russians, they were from an internal source from the Hillary Campaign.
We later reported that Butowsky and his attorney, Ty Clevenger, requested and obtained documents from the FBI related to their case which we were able to analyze.
According to the duo, they obtained the transcript from former FBI Chief of Staff James Rybicki where he states that the Obama White House was the entity that was pushing the Russia conspiracy as early as October 2016 –

This afternoon I received an undated (and heavily redacted) transcript of an interview of James Rybicki, former chief of staff to former FBI Director James Comey, that includes this excerpt: “So we understand that at some point in October of 2016, there was, I guess, a desire by the White House to make some kind of statement about Russia’s…” and then the next page is omitted.
Roger Stone’s Indictment
Trump friend Roger Stone was indicted after being charged by the Mueller gang based on this key question – who provided the DNC and Podesta emails to WikiLeaks?
The corrupt FBI and Mueller team claim the emails were hacked but neither entity inspected the DNC server which was supposedly hacked. They have provided no proof of this.
Former NSA whistleblower Bill Binney claims he has evidence the DNC emails were not hacked but copied most likely on to a flashdrive or something similar.

When Ty Clevenger requested documents from the FBI related to any investigation into the death of Seth Rich, they replied that they never investigated Seth Rich and they don’t have any records on him –
But when documents were requested from the NSA, they replied that they won’t release their records regarding Seth Rich because it’s a matter of national security –
USC 552(b)(1) states: This section does not apply to matters that are—
(A) specifically authorized under criteria established by an Executive order to be kept secret in the interest of national defense or foreign policy and (B) are in fact properly classified pursuant to such Executive order;
We didn’t believe the FBI never investigated the Seth Rich murder even though the NSA said the case was a matter of national security.
Attorney Ty Clevenger requested documents again from the FBI related to any communications related to the death of Seth Rich –
Clevenger claimed that the FBI did not perform its search in good faith after first declaring that they did not have to perform the search. Clevenger also claims that his client, Ed Butowsky, has information that the Seth Rich’s devices were inspected and he wants the results of those investigations –
Clevenger wants the FBI to continue their search and not cover things up because their first review for documents related to Seth Rich was inadequate.

Clevenger has requested that the US Department of Justice provide him documents he is requesting based on some new information and Clevenger also asked the court to allow him to compel the FBI to produce Mr. Hardy (the individual at the FBI who has not provided documents requested) and the chief of CART as witnesses at an evidentiary hearing –
Clevenger made his request based on some new information that he obtained related to actions the FBI took related to Seth Rich. According to Michael Isikoff who is formerly with Newsweek and now with Yahoo (yes, the same individual involved in the Russia collusion hoax) the FBI had numerous activities related to Seth Rich. On page two of Clevenger’s motion, Clevenger notes the following discussion that can be heard on Isikoff’s podcast –

Ty Clevenger reported that he received a response from the FBI and they basically said that the DOJ was lying. Clevenger writes –
Now, back to today’s events. In the response filed this afternoon, the FBI attacked the statements of Mr. Isikoff and Ms. Hines as “unsworn” and “hearsay,” and insisted that it did not need to conduct any more searches for records about Mr. Rich. Mind you, I’m just asking the FBI to pick up the phone and call its Computer Analysis Response Team (“CART”) and ask whether CART has any records about Seth Rich. The FBI refuses to do that, even though it has twice called the Washington Field Office (“WFO”) to ask whether WFO had any records about Mr. Rich.
According to the FBI, any CART records would have shown up in the index search of the FBI’s Central Records System (“CRS”). As I explained in a September 17, 2019 motion, however, the FBI had already admitted that not everything gets entered in the CRS. And now we’ve got the former prosecutor who was assigned to Seth Rich’s case admitting that the FBI investigated his electronic devices… yet the FBI refuses to search for records in CART, the place where such records would most likely be found. Suspicious, no?
Clevenger requested a meeting with the FBI but he was out of luck. The FBI’s denials stuck. It looked like the FBI was trying to hide something and either the FBI or the DOJ are a bunch of liars, or maybe both?
On Monday, January 27, 2020, we had a stunning update ==>>
After previously claiming no FBI records could be found related to Seth Rich, emails were uncovered. These emails weren’t just from anybody. These emails were between FBI lovebirds Peter Strzok and Lisa Page, the two most corrupt individuals involved in the Russia Collusion Hoax.
In a set of emails released by Judicial Watch on January 22, 2020, provided by a FOIA request on Peter Strzok and Lisa Page, multiple emails were found referring to Seth Rich:

What’s also unreal is that the individual releasing the emails to Judicial Watch, David M. Hardy, is also the Deep State crook who claimed he couldn’t find any emails related to Seth Rich to Ty Clevenger. Per Clevenger, he was never contacted by Hardy or the FBI to notify him that Seth Rich emails have been found.
Clevenger has prepared an email and he will notify the court tomorrow and will provide the following complaint to US Attorney Durham, US Attorney Donoghue and DOJ Inspector General Horowitz:

The initial response to the query from the Public Affairs Office of the Washington Field Office is telling. The Agent could have responded very simply–The FBI was not involved in any facet of the Seth Rich investigation. This was a local matter handled by the DC Police.
But that is not how the Agent responded. And then he took the step of adding in people at FBI Headquarters. How do we know this? The message from the Washington Field Office at 7:09 pm was sent to the Criminal Division to Agents Moffat and Strzok.
Ty Clevenger now has ample ammunition to return to court and insist that the FBI be required to identify all agents involved in these email chains and to discuss what they knew about the Seth Rich case. David Hardy declared under the penalty of perjury that there were no such emails. I doubt that the two judges involved in the relevant cases on this matter will be happy to learn that the FBI stonewalled a valid FOIA request.
Christopher Wray’s FBI is still corrupt and dishonest and no effort has been made to clean house. There is likely no reason for the redactions in the emails to Judicial Watch as well.
The FBI continues to lie and cover up its criminal deeds. Director Wray is doing nothing to clean house. He is part of the problem. The Deep State must go. Americans demand the truth!
Centrist Democrat think tank Third Way found that voters populating three battleground states are largely opposed to Medicare for All.
While Senators Elizabeth Warren and Bernie Sanders have turned “Medicare for All” into a rallying cry in their 2020 campaigns, many voters on the left refuse to flock to that banner. A Third Way poll found in the “blue wall” states of Michigan, Pennsylvania, and Wisconsin, socialized medicine is viewed just as critically as President Donald Trump’s Affordable Care Act replacement strategy.
Support for a socialistic approach to our national health care crisis was in a minority 47% in Wisconsin, with even more anemic 41% and 40% in Michigan and Pennsylvania, respectively. The poll did not, however, ask about the “public option” alternative championed by former Vice President Joe Biden.
Third Way polled over 3,500 moderate Democrats, a significant majority of which were Pennsylvanian. Results aligned with previous findings by joint polling from Cook Political Report and the Kaiser Family Foundation: while a majority on the left support Medicare for All, swing voters generally do not.
The poll also found that most voters questioned believe the middle class will be forced to foot the bill for socializing the American healthcare system, though supporters continue to argue that the tax burden would be offset by the elimination of insurance premiums and deductibles.
The bottom line: if either of the two popular progressive candidates manages to clinch the nomination, their complete overhaul of U.S. health care may be a hard sell — even to their base.
Utah Attorney General Sean Reyes took the stage on Tuesday atthe Department of Transportation (DOT) where he recalled meeting with President Donald Trump not long after the 2016 election about the scourge of human trafficking.
“Let me give credit first to our president, Donald J. Trump,” Reyes said. “I had occasion to share with him in the Oval Office photos from a rescue that I did undercover in another country,” Reyes said.

“My team posed as the bad guys, as sex buyers. We flushed out the real traffickers, rescuing dozens of little girls in that nation,” Reyes said. “And when the president saw the pictures and heard the stories, he said, ‘Sean I’m going to make fighting this a priority.’”
“And guess what?” Reyes said. “He has.”
Part of that promise to prioritize human trafficking unfolded at DOT where Secretary Elaine Chao convened panels of experts to discuss how the federal government can partner with state and local governments and the private sector to fight human trafficking in the nation’s transportation infrastructure.
Kendis Paris, executive director of Truckers Against Trafficking (TAT), said there are more professional drivers on American roads than law enforcement, and they can and are making a difference.
“Traffickers use very mode of transportation to move their victims and sell them along major transportation routes,” Paris said.
She shared stories about truckers who have rescued victims and helped investigators after getting training from TAT and reacting to suspicious activities at truck stops and hotel parking lots.
Reyes said in his remarks that one of the challenges in the fight to end human trafficking is getting people to understand its significance.
“The biggest problem when it comes to human trafficking remains this: Most people still have no clue that it even exists,” Reyes said. “But with events like these, we united, need to set the record straight.”
“While the history books in our schools teach that slavery has ended, it most certainly has not,” Reyes said. “And we need now, more than ever, professionals from the transportation industry, in government, in the private sector, to stand up with us and fight this fight.”
Also on hand at the event were lawmakers Rep. Henry Cuellar (D-TX), who backed $2.4 million for the Crime Victims Fund in the most recent spending bill and also secured money to support the President’s Interagency Task Force to Monitor and Combat Trafficking in Persons, and Rep. Chris Smith (R-NJ), who authored the Trafficking Victims Protection Act in 2000 and is also behind four other major pieces of trafficking legislation, including the 2020 Frederick Douglass Trafficking Victims Prevention and Protection Act.
“Human trafficking is a barbaric human rights abuse that thrives on greed, secrecy, a perverted sense of entitlement to exploit the vulnerable, and an unimaginable disregard for the victims,” Smith said at Tuesday’s event.

“The U.S. Department of Transportation is committed to working with our public and private partners to fight human trafficking on America’s transportation system,” Chao said.
Chao announced the “Transportation Leaders Against Human Trafficking” pledge to train the transportation workforce and raise public awareness on human trafficking.
“To amplify counter-trafficking efforts, Secretary Chao established an annual $50,000 award to incentivize individuals and entities, including non-governmental organizations, transportation industry associations, research institutions, and State and local government organizations, to think creatively in developing innovative solutions to combat human trafficking in the transportation industry,” the DOT press release said.
“Secretary Chao also announced $5.4 million in grant selections through the Federal Transit Administration’s (FTA) Human Trafficking Awareness and Public Safety Initiative,” the DOT press release said.
Twenty-four organizations in the United States will each receive funding for projects to help prevent human trafficking and other crimes on public transportation.
