Public University Gets Worst Possible Free Speech Rating For Social Media Policy

A public university in Alabama has earned the worst rating it could possibly receive by a free speech watchdog group for its social media and email policies, which include prohibiting “harsh text messages,” spreading “rumors,” and posting “embarrassing” pictures of other students.

As reported by The College Fix, the University of West Alabama’s Cyberbullying and Cyber Harassment Policy received a “red light” rating from the Foundation for Individual Rights in Education (FIRE) for its free speech-threatening anti-harassment policies.

The policy forbids any form of cyberbullying or cyber-harassment, defined vaguely as “conduct that disrupts the educational environment of the university,” including “harsh text messages or emails, rumors sent by email or posted on social networking sites, and embarrassing pictures, videos, websites, or fake profiles.”

“Cyberbullying or cyber harassment by any member of the University of West Alabama community (student, faculty, staff, etc.) toward another individual constitutes conduct that disrupts the educational environment of the University,” the policy reads. “Examples of cyberbullying and cyber harassment include, but are not limited to, harsh text messages or emails, rumors sent by email or posted on social networking sites, and embarrassing pictures, videos, websites, or fake profiles.”

“The University will not tolerate lewd, intimidating or other disorderly conduct by or toward members of its community,” the policy explains, then provides the following “exmples of instances where social media can cause harm to the University or member of the UWA community or may violate policies”:

  • A UWA student establishes a Twitter account that encourages others to submit anonymous messages to an account that will be redistributed by the account holder.
  • A member of the University community establishes a fake account under the name of an official University department or organization and uses the name and trademark to post vicious comments on other content.
  • A member of the University faculty or staff uses his or her blog or social media account to berate or otherwise discuss engagement with or judgment of a student’s work or other information considered confidential or proprietary by FERPA or HIPPA.

The College Fix has attempted to get more details on the policy, particularly “whether any students had ever been sanctioned by the school for sending a harsh text message,” but so far hasn’t gotten any response.

FIRE awarded the university its worst possible “red light” rating for the policy, given when “an institution has at least one policy that both clearly and substantially restricts freedom of speech.” FIRE defines a “clear” restriction as “one that unambiguously infringes on what is or should be protected expression.”

“The University of West Alabama’s ‘Cyberbullying and Cyber Harassment Policy Statement’ earns FIRE’s worst ‘red light’ rating because it is a clear and substantial restriction on constitutionally protected expression,” FRE’s Laura Beltz said in a statement reported by The College Fix.

“Online messages do not lose First Amendment protection simply because they’re subjectively viewed as harsh, embarrassing, or as an unverified rumor,” Beltz explained. “For example, a single tweet that criticizes the university administration would be punishable under this policy, but would typically be protected by the First Amendment.”

The university policy, said Beltz, should be revised to meet the Supreme Court’s strict standard for peer harassment in the educational setting, which “requires conduct to be so severe, pervasive, and objectively offensive that the individual is effectively denied equal access to the university’s resources and opportunities — far from a single harsh text or an embarrassing email.”

As Cristina Laila noted yesterday, TGP previously reported in February, that fired FBI Director McCabe altered far left FBI investigator Peter Strzok’s 302 notes on his interview with General Michael Flynn.

Reports are now circling that not only did corrupt former FBI Head McCabe alter the 302 regarding the interview with General Flynn that later was used to get Flynn fired and indicted by the corrupt Mueller team, McCabe and his corrupt gang also destroyed the supporting documentation for the 302.

Internet sleuths are again at it. New reports are out suspecting that corrupt and fired former FBI Head McCabe destroyed evidence that General Flynn was innocent and did not lie to FBI agents when interviewed shortly after the 2017 Inauguration. Flynn was later indicted by the corrupt and conflicted Mueller team.

Some on the free Internet (i.e. not the MSM) also point out that one of Mueller’s gang, Andrew Weissmann, did the same thing years ago in the government’s case against Enron.

No wonder corrupt DOJ Deputy AG Rosenstein is not providing these documents to the Senate. They’ve all been destroyed.  Also, Mueller’s team may not be doing the same which was ordered by Judge Sullivan in the Flynn case.  This would appear to be grounds to drop charges against Flynn.

Corrupt and fired former DOJ AG Sally Yates destroyed evidence in the past as well. She is the one who went to the White House and complained that General Flynn had lied.

General Flynn’s innocence cannot be declared soon enough.  He and his family have gone through so much due to these horrible corrupt human beings.  These goons who set him up need to be brought to justice.  Drain the Swamp!

Teacher Fired For Refusing To Say Transgender Student’s Name

A teacher at an Indiana high school claims administrators forced him to resign over his refusal to call a transgender student by the student’s desired name.

According to ABC News, Brownsburg High School in Indiana has a policy requiring teachers to call transgender students their desired names over their birth names. When the orchestra teacher John Kluge refused to comply in the name of free speech, opting instead to simply use the student’s last name, administrators came down hard on him, he alleges.

“I feel the compelled speech of forcing a teacher to take a side on this very highly controversial topic is a violation of our First Amendment rights,” Kluge told ABC affiliate WRTV.

Kluge claims that the school told him to follow the policy, resign, or face termination. After submitting a conditional resignation, he later withdrew it. However, a school district representative claims he voluntarily submitted the resignation, which they accepted.

Kluge recalled his meetings with administrators as “very threatening” and “bullying.”

“I enjoy being the orchestra teacher at Brownsburg,” Kluge wrote in a statement. “It’s unfortunate that the administration is not letting me come back and that they are unwilling to continue a reasonable accommodation that most people consider to be very common sense.”

The administration claims to have complied with state and federal laws. The Brownsburg Community School Corporation also has a rule stipulating that a student can use their preferred name only with a letter from a parent and a healthcare professional.

LGBTQ activists celebrate the firing and say Kluge’s attitude contributes to suicide rates.

“Showing a lack of support for transgender youth is what drives up the suicide rates of transgender youth in Indiana,” said Chris Paulsen, executive director of the LGBTQ organization Indiana Youth Group.

On Thursday night, discussing with Reverend Jesse Jackson the brouhaha between President Trump and the Philadelphia Eagles over Trump rescinding the team’s invitation to the White House, Fox News host Laura Ingraham took on Jackson’s insistence that some black American celebrities were “insulted by the violations of our people by this president.”

Ingraham pointed out that the Eagles only planned to send a few of the members of their team to the White House, after sending 80 names to the Secret Service. “That’s really lame,“ she said. Jackson replied that Colin Kaepernick, LeBron James and Steph Curry were “insulted by the violations of our people by this president.”

Ingraham fired back, as the screen pointed out that black unemployment had plunged to record-low numbers, “Is that because of black unemployment? Is that part of the violations of the people? Is there any good news for black America under this administration? Do you like the unemployment numbers? Do you like small businesses being created?”

Jackson responded, “He inherited a growing economy. When President Barack came, we lost 800,000 jobs that month.

Ingraham said (of Trump): “He gets no credit?”

After Jackson praised Obama’s record, Ingraham noted, “Wages weren’t going up.”

Jackson then attacked Trump for his remarks about tariffs and the the G-7, prompting Ingraham to respond:

How you’re turning that into an anti-black thing is beyond me. Were you okay with like millions of jobs were being sent overseas due to globalization and millions of jobs were being bled off to countries like Mexico? That was good for black America? Because call me crazy, but I don’t think that was good for working class people at all. We lost millions of jobs. And this president is actually bringing jobs back to the United States and doing stuff like prison reform with Jared Kushner and others who were working together, including even Democrats. From what I could hear, this president has done nothing good for black America, is that what you’re saying tonight? Nothing?

Exclusive — Congressman Lee Zeldin: Amnesty Discharge Petition ‘Vehicle’ for ‘Whatever Nancy Pelosi’ Wants

Rep. Lee Zeldin (R-NY) says the Republican establishment’s discharge petition — which would force a vote on an expansive amnesty for illegal aliens — would be a “vehicle” for “whatever” House Minority Leader Nancy Pelosi (D-CA) wants on immigration.

In an interview with SiriusXM’s Breitbart News Sunday, Zeldin told Breitbart News Deputy Political Editor Amanda House that Republicans in Congress should be opposing the discharge petition, which a group of “Never Trump” GOP lawmakers are pushing.

Zeldin told Breitbart News Sunday:

I didn’t sign the discharge petition, I actually oppose the discharge petition. It’s a vehicle in my opinion that basically creates a process to pass whatever Nancy Pelosi and the Democrats are going to pass. That’s the version that would get the votes.

I think it’s really important for us to understand that this is a difficult issue, yes, but just because we have such a strong desire to pass an immigration bill doesn’t mean that we should be in a rush to pass any immigration bill. And we can’t repeat the mistakes of the past where if you pass the wrong bill, you end up incentivizing illegal immigration where the numbers start to even multiply.

The group of Republicans have signed onto what is known as a “discharge petition” to force a vote to bring an expansive amnesty plan for illegal aliens enrolled and eligible on the President Obama-created Deferred Action for Childhood Arrivals (DACA) program to the House floor.

The discharge petition could lead to the massive DREAM Act amnesty — which would give amnesty to the majority 12 to 30 million illegal aliens in the U.S. — being passed out of the House and Senate with a veto-proof majority.

Months of polling has revealed that a no-strings amnesty for illegal aliens is unpopular with GOP voters. GOP voters and swing voters have consistently told pollsters by huge majorities that they want to see legal immigration levels decreased to raise wages for America’s working and middle class.

Ted Cruz: Six Conservative Victories of the Trump Presidency

Sen. Ted Cruz (R-TX) spoke at the Road to Majority conference in Washington, DC, on Thursday, listing six victories for conservatives that have taken place since President Donald Trump was elected the forty-fifth President of the United States.

Cruz, who was vying with Trump for the Republican nomination in the 2016 presidential race, listed what has been accomplished in less than two years.

• Cruz cited the confirmation of Neil Gorsuch as the U.S. Supreme Court justice, who now can make a fifth conservative vote.

• In fact, Cruz noted the role Gorsuch played in the recent 7-2 decision in favor of a baker who had been punished for his refusal to violate his religious beliefs by baking a wedding cake that celebrated same-sex marriage. The high court said the Colorado Civil Rights Commission had targeted Jack Phillips because of his faith.

Cruz said although it is being described as a “narrow” decision, “that is not narrow; that is a bedrock principle of our First Amendment and our nation.”

• Cruz listed Trump’s pro-life accomplishments, including reinstating the Mexico City policy that prohibits federal funds going to organizations abroad that perform or promote abortion; appointing a pro-life Supreme Court justice; defunding the United Nations’ Population Fund, which supports forced abortions in China; denying Planned Parenthood Title X federal family planning funds; and rescinding Obamacare’s contraceptives mandate.

“Human life, innocent life, every life, Cruz said, is “a precious gift from God that deserves to be protected from the moment of conception to the moment of natural death.”

• Historic tax cuts will not only save Americans thousands of dollars on their annual returns, but has already created jobs and caused many employers to give employees bonuses. Cruz, who campaigned on abolishing the Internal Revenue Service (IRS), praised the new tax law passed by Congress and signed into law by the president.

“Ninety percent of Americans will be able to fill out their taxes on a postcard,” Cruz said.

• Although Congress has not repealed all of Obamacare, lawmakers were able to pass legislation that removed the individual mandate, which imposed IRS fines on Americans who could not afford the sky-rocketing cost of health insurance.

Cruz said this development could help as many as 6.5 million Americans.

• Finally, Cruz praised Trump’s decision to move the U.S. embassy to Jerusalem, saying he was “almost embarrassed” it took so long.

Masters of the Universe: Facebook Bug Shared 14 Million Users’ Private Posts with the Entire World

Reports published late this week suggest that a Facebook software bug may have caused user’s private posts to be shared publicly.

According to the report, as many as 14 million Facebook users were affected by the software bug, which quietly switched “private” posts to “public.” Although the software bug was only active for 10 days in May, some tech analysts are concerned about the impact of such a mishap in the context of Facebook’s recent struggles to regain user trust after the company’s recent data scandals.

We’d like to apologize for this mistake,” Erin Egan, Facebook’s chief privacy officer, said in a statement on Thursday. “We have fixed this issue, and starting today we are letting everyone affected know and are asking them to review any posts they made during that time.”

In April, Facebook admitted that they were scanning the private conversations of Messenger users. The Silicon Valley giant even admitted that they were analyzing photos sent between users on their messaging platform.

“For example, on Messenger, when you send a photo, our automated systems scan it using photo matching technology to detect known child exploitation imagery or when you send a link, we scan it for malware or viruses,” a Messenger spokesperson said. “Facebook designed these automated tools so we can rapidly stop abusive behavior on our platform.”

Facebook has faced heightened scrutiny since the beginning of the year as a result of a data scandal that involved the leaking of personal information from millions of user accounts. At the end of March, Facebook took out a full-page ad in several major newspapers to apologize for the data leakage.

Facebook says it is reaching out to users this week that were affected by the May software bug.
