Devin Nunes suing Twitter for defamation, shadow-banning, and censoring conservatives and ignoring lawful complaints of abuse

Conservatives angry over the suppression of their views on social media may be getting their day in court thanks to Rep. Devin Nunes, who yesterday filed a lawsuit in Henrico County, Virginia (full complaint here) seeking:

… $250 million in compensatory damages and $350,000 in punitive damages against Twitter and a handful of its users on Monday, accusing the social media site of “shadow-banning conservatives” to secretly hide their posts, systematically censoring opposing viewpoints, and totally “ignoring” lawful complaints of repeated abusive behavior. Nunes claimed Twitter wanted to derail his work on the House Intelligence Committee, which he chaired until 2019, as he looked into alleged and apparent surveillance abuses by the government. Nunes said Twitter was guilty of “knowingly hosting and monetizing content that is clearly abusive, hateful and defamatory – providing both a voice and financial incentive to the defamers – thereby facilitating defamation on its platform.”

The lawsuit alleged defamation, conspiracy and negligence, as well as violations of the state’s prohibition against “insulting words” – effectively fighting words that tend towards “violence and breach of the peace.” The complaint sought not only damages, but also an injunction compelling Twitter to turn over the identities behind numerous accounts he said harassed and defamed him. I presume that Nunes chose to file in Virginia to avoid exposure to the Ninth Circuit Court of Appeals in California and District of Columbia juries, drawn from a pool that votes overwhelmingly for Democrats.

A key element in the lawsuit is a challenge to Twitter’s claim of protection under:

Section 230 of the Communications Decency Act [that] says they should not “be treated as the publisher or speaker” of the content — allowing the platforms to exist without having to preapprove every post for potential legal issues. (via the New York Times)

But if the complaint’s allegations are true, then Twitter, by favoring some viewpoints over others, is in effect a publisher with responsibility for the content that it favors, not a platform equally accessible to all, and therefore not liable for whatever content appears there.

Senator Josh Hawley has been pushing for a modification of the Communications Decency Act, and recently discussed this for ten minutes at CPAC:

No doubt, Twitter will seek to have the lawsuit immediately dismissed, but if it is allowed to proceed, the key will be the discovery process, in which the plaintiff (Nunes) can demand disclosure of the algorithms used by Twitter, a well as all internal documents discussing moderation, identification of accounts it regards as problematic, and other evidence of possible bias. More than any actual damages (although a quarter billion dollars is nothing to sneeze at), access to this information couldbe very important.

The New York Times’s accuunt of the lawsuit is unusually blatant in its bias, starting with a headline that ignores many of the specifics of the complaint:

Mr. Nunes repeated the debunked claim that the social network was “shadow banning” Republicans, including him. Shadow banning — the act of a platform allowing someone to post but not allowing others to see the post, effectively making them invisible — became a political catch phrase in July, when a Vice News article used the term to characterize a Twitter bug that was affecting some prominent conservatives.

The Times is not alone in seeking to cast the lawsuit in negative terms. CBS starts its article with the loaded language, “Republican Rep. Devin Nunes of California, the controversial, arch-conservative….”  But this time,  the Washington Post was fairly straightforward in its report.

The lawsuit also identifies Republican consultant Liz Mair as the author of allegedly libelous content. She has (so far) four times asked for donations to a legal defense fund on her Twitter feed since the lawsuit was announced late yesterday.

WAR ON DEMOCRACY: Fauxahontas Calls For Abolishing The Electoral College

Not only are the Democrats now pushing full-blown socialism as well as protecting the anti-Semites in their ranks but they are also looking to radically configure the way that the democratic process has ALWAYS functioned in America.

Following Hillary’s crushing loss despite winning the popular vote (translation: she kicked Trump’s ass in California) the left has been feverishly working to eliminate the Electoral College in order to effectively rig all elections going forward in favor of the big cities populated by the coastal elite.

Efforts are picking up speed after Colorado became the latest state to join ten others that are seeking to circumvent the Constitution and the idea of the Founding Fathers that one or two big states would not be allowed to benefit from numbers while disenfranchising large chunks of the nation.

On Monday night during the latest of their “town halls’ which are really infomercials for Democrats using stacked audiences, CNN hosted Elizabeth “Pocahontas” Warren for the Q & A and lo and behold, the lying fake Indian is down with the elimination of the Electoral College too.

Sen. Elizabeth Warren (D., Mass.) said Monday she supported eliminating the Electoral College in presidential elections.

Speaking at a CNN town hall in Jackson, Mississippi, Warren laid out her proposed voting reforms to Democratic primary voters.

“We need to make sure that every vote counts,” she said, before going on to say in presidential election years, candidates ignore states like Mississippi, as well as blue states like California and Massachusetts, because they’re not battleground states.

“My view is that every vote matters, and the way we can make that happen is that we can have national voting, and that means get rid of the Electoral College,” Warren said, to cheers and applause.

Warren is one of more than a dozen Democrats vying for the 2020 nomination.

Its longtime Constitutional role has never been a problem until 2016 when Hillary Clinton’s condescending stance toward working-class whites in the Rust Belt brought down that “blue wall” and helped to deliver the presidency to Donald Trump.

One more example of the dangerous totalitarianism that has now consumed the Democratic party.

Efforts to nullify the Electoral College will intensify and this issue is headed to the Supreme Court which makes it all the more important to support Trump who will appoint pro-Constitution judges to the bench instead of fire-breathing extremists whose ideologies are in line with the cadaver RBG.

Tucker Carlson Breaks Down The Russian Hoax As Media Moves Back To Race Baiting

Democrats continue to retreat to their fallback position that President Trump is a white supremacist who is to blame for last week’s horrific massacre at two New Zealand mosques which is as sure a sign as any that the Mueller report is going to be a dry hole in terms of Russian collusion.

Now that most indications are that the deep state dirty cop will drop his long-anticipated report in the near future, it is going to likely be a massive disappointment to Dems and their cadres of conspiracy-spewing babbling idiots in the media.

The Russian hoax may one day go down as the greatest lie ever perpetrated by the media against the American people but it has allowed the rabid political left to muster great support for the neo-Stalinist police state tactics that have been used by Mueller and this Gestapo such as pre-dawn, no-knock paramilitary raids on the homes of Paul Manafort and Roger Stone and the ransacking of the office of Michael Cohen, the lying cheese-eating rat who turned on Trump.

Trump himself has always called it what it was and is delighted by the results of a new USA TODAY/Suffolk University Poll that shows that the public has caught on to Mueller’s horseshit.

Bernie Sanders wants you to know he’s electable. No… really

I’m Good Enough. I’m Smart Enough. I’m Socialist Enough, and Doggone It, People Like Me!

By any measure, Senator Bernie Sanders (Socialist – Vermont) is off to a very solid start in the Democratic primary race. He’s the only declared candidate within spitting distance of the as-yet undeclared Joe Biden in the national polling and even leads him narrowly in a couple of states. He raised more money in the first 24 hours of his candidacy than anyone except Beto. And he’s entering the race with one thing most of his potential primary opponents don’t have: the experience that comes from running a bruising, 50-state campaign, along with a lot of experienced staffers who have been down this road before.

But Sanders still has one serious hurdle to overcome. Is he “electable enough” to break through in the general election? I suppose this is the equivalent of the “likable enough” question that female candidates rail against. It’s a serious question for the Democratic base to consider, but Bernie wants you all to know that it’s not a problem. He’s totally electable… probably. (Associated Press)

As he revs up his second presidential campaign, the Vermont senator and his supporters are putting his case for winning the general election at the center of the argument. The emphasis is meant to aggressively confront the perception that Sanders, a self-described democratic socialist, is too liberal to win over the coalition needed to win the White House. That question dogged Sanders’ campaign for the Democratic nomination four years ago. This time he is trying to shake it early…

What Trump was offering “was faux-Bernie Sanders in order to beat Hillary Clinton,” Sanders campaign manager Faiz Shakir said, adding that Sanders plans to focus on the three states even as he fights off a crowded field of Democrats vying for the nomination in states with early primary contests. “We will invest, we will go to these states and demonstrate through real action, and hopefully data and numbers, that we can beat Donald Trump.”

It’s easy to understand not only Sanders’ predicament but the strategy he’s employing in an attempt to counter it. His spokespeople are already out there making the case that the crazy ideas he was floating during his 2016 battle against Hillary Clinton have now been adopted by many of the Democrats running for the nomination. In that sense, he’s absolutely correct. Hard left, socialist talking points have essentially become mainstream thinking on the left. But that’s also still his biggest problem. They are only mainstream among the younger elements of the Democratic base.

No matter who wins the Democratic nomination, whether it’s Bernie or one of the younger hopefuls, if they are preaching socialism they have to sell the idea to the moderates and independents of the nation on election day. As Ed pointed out yesterday, Sanders has been busily trying to make that sale, but history – both ancient and current – provides too many examples of how badly socialism almost always ends.

To be sure, we’ve seen an alarming shift in the numbers, primarily from people who haven’t been around long enough remember the bad old days. One recent poll showed that 57% of registered Democrats view socialism more favorably than capitalism. That’s certainly disturbing, but we should also note that you’re still only talking about slightly more than half of your own base. If 47% of your own core voters aren’t so wild about socialism, you’re going to have a tough row to hoe in the general election.

So how does the rest of the country view the topic? As recently as last summer, polling showed that a whopping 76% of Americans overall said they would not vote for a socialist. Those numbers may have slid down a bit since then, but not by that much. So Bernie’s electability argument is on shaky ground to start with. But as far as I’m concerned, the Democrats should go full bore into the breach and nominate a socialist. I’m sure they’ll do just fine.

Evidence: Millions of students, kindergarten through graduate school who, due to brainwashing and indoctrination by a leftist dominated educational system, believe socialism is The Way and that “the planet” is in immanent danger of environmental destruction; millions of criminal invaders, entirely unvetted, possibly disease carrying, allowed to roam free, murdering, raping, stealing at will, and adding the coup de grace, voting in our elections in massive numbers; dozens of high government officials who are known to have indisputably committed multiple felonies, breaking a myriad of federal laws, continuing to hold positions of power, and/or walking around free and unindicted; an out of control deficit and a similarly out of control federal budget; leftist terrorists, by the government’s own definition, allowed to continue violent attacks on conservatives with little, but mostly no punishment; a media engaged in 24/7/365 dissemination of lies, slander, libel, disinformation, distortion, obfuscation, and propaganda; the Democrat Party, encouraging, funding, instigating, covering up for, constantly lying about, and engaging in all of the above; a judiciary dominated by leftist judges who regularly and without fear of consequences, create law from their personal political agendas; and, pathetically sad to say, the Republican Party doing nothing of substance to slow, much less stop this, and worse, often aiding and abetting.

Dirty Cop Mueller’s Right Hand Man Weissmann Threatened Witnesses for Telling the Truth

Recent uncovered documents from the DOJ’s Enron case in the early 2000’s show that sleezy Andrew Weissmann, dirty cop Robert Mueller’s top attorney, intimidated witnesses and threatened them when they told the truth.

One of the best Internet sleuths on Twitter, Techno Fog, recently requested and uncovered information on the government’s case with Enron from the early 2000’s.  Robert Mueller was head of the FBI and the person in charge of the government’s case was Andrew Weissmann.

Weissmann was a crook who never should have been prosecuting anyone.  Attorneys and authors Gregg Jarrett and Sydney Powell were on the Sean Hannity radio show and discussed Mueller’s creepy prosecutor Weissmann and the corrupt Mueller investigation –

Powell referred to Weissmann from the early 2000’s.  She claims that he should never-ever be a prosecutor.  Documents uncovered from Techno Fog confirm this.  One attorney stated that Weissman threatened that speaking with a defendant “could get his client’s indicted”.

The Court issued an order that there would be no retribution for cooperation with the defense.

This is the kind of person the Robert Mueller invited on his team to “investigate” President Trump.

Weissmann, who was involved in the early stages of the fake Russia dossier, who was at Hillary’s inauguration party, was Mueller’s first choice.

These crooks should die in prison!
